A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
COASTAL DEVELOPMENT PERMIT NO. CDP 98-07 TO
ALLOW FOR THE REPLACEMENT OF THE GRAVITY
SEWER PIPELINE ALONG JEFFERSON STREET BETWEEN
LAS FLOES DRIVE AND LAGUNA DRIVE IN LOCAL
FACILITIES MANAGEMENT ZONE 1.

WHEREAS, the City’s Engineeringmublic Works Department, “Del
has filed a verified application with the City of Carlsbad regarding property owned bq

The public right-of-way of Jefferson Street between Las Flores
Drive and Laguna Drive.

WHEREAS, said verified application constitutes a request for a
Development Permit as shown on Exhibits “A”-“J” dated April 1, 1998, on file in the
Department, VistaKarlsbad Interceptor Sewer Replacement Reaches VCSB - VC9,
07 as provided by Chapter 21.201.040 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 1st day of April 199
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all t
and arguments, if any, of all persons desiring to be heard, said Commission considered 5
relating to the CDP 98-07.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission of the City of Carlsbad as follows:

B) That based on the evidence presented at the public hearing, the Cor

conditions:
Findings:
1. The project is consistent with the General Plan in that it fbllfills a public utility infra,
need in support of demand generated by existing and proposed land uses establishe
land use element of the General Plan.
2. That the proposed development is in conformance with the Certified Local Coastal
and all applicable policies in that
a) The project proposes the repair and replacement of an existing sewer pipeline
within an existing public street and the LCP Land Use Plan designates the subjec
transportation and public utility uses.
b) The proposal is in conformity with the public access policies of Chapter 3 of the
Act in that the replacement of the underground pipeline would not permanentl!
traffic circulation and patterns, or restrict access to coastal resources.
c) The planned construction would take place within an existing public street, there:
project construction will not impact coastal resources such as coastal bluffs, steel
or native coastal vegetation.

1. Staff is authorized and directed to make, or require Developer to make, all COT
and modifications to the document(s) necessary to make them internally consisl
