PLANNING COMMISSION RESOLUTION NO. 4265
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
HILLSIDE DEVELOPMENT PERMIT ON PROPERTY
GENERALLY LOCATED ON THE WEST SIDE OF OCEAN
STREET BETWEEN CYPRESS AVENUE AND BEECH
AVENUE IN LOCAL FACILITIES MANAGEMENT ZONE 1.
CASE NAME: OCEAN STREET CONDOMINIUMS-
PALISOUL/BLAIR RESIDENCE
CASE NO: HDP 97- 14
WHEREAS, Cindy Blair, “Developer”, has filed a verified application
City of Carlsbad regarding property owned by Philip R. Palisoul and Pamela F.
husband and wife, as joint tenants, and Martin L. Blair and Cynthia S. Blair, husk
wife, as joint tenants, “Owner”, described as
Lots 15 and 16 in block “A” Hayes Land Co. Addition to
Carlsbad Map No. 2, City of Carlsbad,
(“the Property”); and
WHEREAS, said verified application constitutes a request for a
Development Permit as shown on Exhibits “A” - “G” dated May 6,1998, on file in the
Planning Department OCEAN STREET CONDOMINIUMS - PALISOUI
RESIDENCE, HDP 97-14 as provided by Chapter 21.95 of the Carlsbad Municipal Cot
WHEREAS, the Planning Commission did on the 6th day of May, 1998,
said request; and
WHEREAS, at said hearing, upon hearing and considering all testin
arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the Hillside Development Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Cor
RESIDENCE, HDP 97-14, based on the following findings and subje
following conditions:
APPROVES OCEAN STREET CONDOMINIUMS - PALISOUL
Findings:
1. That hillside conditions have been properly identified on the constraints map wh
existing and proposed conditions and slope percentages.
2. That undevelopable areas of the project, i.e. slopes over 40%, have been
identified on the constraints map.
3. That the development proposal is consistent with the intent, purpose, and requirt
the Hillside Ordinance, Chapter 21.95, in that the project will not result in si
grading or disturbance of the hillside, and the project will be compati
surrounding developments, and the project has been designed with a st
building pad to reduce visual impacts of the project.
4. That the proposed development or grading will not occur in the undevelopable p'
the site pursuant to provisions of Section 21.53.230 of the Carlsbad Municipal
that the 40% or greater slopes on the site are generally located on the west
of the site, and the site contains no environmentally sensitive lands.
5. That the project design substantially conforms to the intent of the concepts illu
the Hillside Development Guidelines Manual, in that the project minimizes

on the street side, and is similar to and compatible with surrounding develo]
6. That the project design and lot configuration minimizes disturbance of hillside

Conditions:
1. Staff is authorized and directed to make, or require the Developer to make, all c(
and modifications to the Hillside Development Permit documents, as necessarj

development substantially different from this approval, shall require an amen

2. Approval of HDP 97-14 is granted subject to the approval of SDP 97-17, V 97
97-08 and CDP 97-36. HDP 97-14 is subject to all conditions contained in :
