PLANNING COMMISSION RESOLUTION NO. 4269
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT
BUILDOUT CAPITAL IMPROVEMENTS PROGRAM IS
CONSISTENT WITH THE GENERAL PLAN.
THE 1997-1998 AND 1998-1999 SUPPLEMENT TO THE
CASE NAME: 1997-1 998 AND 1998-1 999 SUPPLEMENT
TO THE BUILDOUT CAPITAL IMPROVE-
MENTS PROGRAM
CASE NO: PCD/GPC 98-01
WHEREAS, the City of Carlsbad , “Developer”, has filed a verified ap
with the City of Carlsbad regarding property owned by various owners, “Owner”, descr
Citywide
(“the Property”); and
WHEREAS, said verified application constitutes a request for a
Commission Determination of General Plan Consistency as provided by Sections 6i
65402 of the California Government Code; and
WHEREAS, the Planning Commission did on the 6th day of May 1998,
said request; and
WHEREAS, at said hearing, upon hearing and considering all testirr
arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, the Cor
DETERMINES that 1997-199s AND 1998-1999 SUPPLEMENT ’I
BUILDOUT CAPITAL IMPROVEMENTS PROGRAM, PCD/GPC
consistent with the General Plan based on the following findings and s
the following conditions:

Findings:
1. The project is consistent with the goals and policies of the City’s General Plan i
project ensures and requires the provision of adequate public facilities anc
concurrent with or prior to actual demand.
2. The project is consistent with the Land Use, Circulation, Public Safety, P
Recreation, and Arts elements of the General Plan in that the project implen
goal of the Land Use Element which requires that public facilities be adec
the projected population.
3. As provided for in the General Plan, the proposed improvements are consisten
City’s Growth Management Plan in that the project ensures that the I
improvements are provided for streets, traffic signals, parks, sewer facilitic
facilities, drainage facilities, and civic projects in accordance with the perf
standards contained in the City’s Growth Management regulations.
Conditions:
1. All projects within the 1997 and 1998-1999 Supplement to the Buildout
Improvement Program shall undergo environmental review as required by
of the Carlsbad Municipal Code, and any mitigation measures required as
of such review shall be complied with in their entirety unless the n
environmental findings (including findings of overriding consideration) are
the City Council.
