A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CHANGE FROM PC TO C-1-Q, AND
C-2 TO C-1-Q FOR THE DEVELOPMENT OF A
NEIGHBORHOOD COMMERCIAL SHOPPING CENTER ON
PROPERTY GENERALLY LOCATED NORTH OF LA COSTA
AVENUE AND EAST OF EL CAMINO REAL IN LOCAL
FACILITIES MANAGEMENT ZONE 6.

WHEREAS, American Stores Properties Inc., “Developer”, has filed a
application with the City of Carlsbad regarding property owned by American Stores Pr
Inc. and Leucadia County Water District, “Owner”, described as

South, Range 4 West, San Bernardino Meridian, in the City of
Carlsbad, County of San Diego, State of California, according
to CT 97-09, Exhibit “A”, dated June 17, 1998, on file in the
Planning Department.

WHEREAS, said application constitutes a request for a Zone Change as s

NOW, THEREFORE, BE IT HEREBY RESOLVED by the I
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Con
RECOMMENDS APPROVAL of LA COSTA LUCKY S
SHOPPING CENTER, ZC 97-02, based on the following findings anc
to the following condition:
Findings:
1. That the proposed Zone Change from PC to C-1-Q and from C-2 to C-1-Q is cc
with the goals and policies of the various elements of the General Plan, in that C-
appropriate zone to implement a Neighborhood Commercial Generi
designation.
2. That the Zone Change will provide consistency between the General Plan and Z(
mandated by California State law and the City of Carlsbad General Plan L:
Element.
Conditions:
1. Approval of ZC 97-02 is granted subject to the approval of GPA 97-02.

The City Council of the City of Carlsbad, California, does ordain as follov
SECTION I: That Title 21, Chapter 21.05, Section 21.05.030 of the (
Municipal Code, being the Zoning Map, is amended to reflect zone changes as shown on
“ZC 97-02”, dated June 17, 1998 attached hereto and made a part hereof by this reference
SECTION 11: That the findings of the Planning Commission as set
Planning Commission Resolution No. 4310 constitute the findings of the City Council.
SECTION 111: The Council further finds that this action is consistent 1
Land Use Element of the Carlsbad General Plan.
EFFECTIVE DATE: This ordinance shall be effective thirty days
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause
published at least once in a publication of general circulation in the City of Carlsbac
fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the CarlsE
