A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE
OF A NEIGHBORHOOD COMMERCIAL SHOPPING CENTER
ON PROPERTY GENERALLY LOCATED EAST OF EL
CAMINO REAL AND NORTH OF LA COSTA AVENUE IN
LOCAL FACILITIES MANAGEMENT ZONE 6
CASE NAME: LA COSTA LUCKY SA-VON SHOPPING
CASE NO.: SDP 97-07
WHEREAS, American Stores Properties Inc., “Developer”, has filed a
application with the City of Carlsbad regarding property owned by American Stores Prc
Inc. and Leucadia County Water District, “Owner”, described as
DEVELOPMENT PLAN SDP 97-07 FOR THE DEVELOPMENT
CENTER
Those portions of Lots 9,14, and 15 in Section 35, Township 12
South, Range 4 West, San Bernardino Meridian, in the City of
Carlsbad, County of San Diego, State of California, according
to CT 97-09, Exhibit “A”, dated June 17, 1998, on file in the
Planning Department.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Site Devel
Plan as shown on Exhibit(s) “A” - “Y” dated June 17, 1998 , on file in the F
Department, LA COSTA LUCKY SAV-ON SHOPPING CENTER, SDP 97-07 as p
by Chapter 21.06 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 17th day of June , 199
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all te:
and arguments, if any, of all persons desiring to be heard, said Commission considered all
relating to the Site Development Plan.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) , That based on the evidence presented at the public hearing, the P
Commission APPROVES LA COSTA LUCKY SAV-ON SHOl
CENTER, SDP 97-07 based on the following findings and subject
following conditions:
Findinzs:
1. That the requested use is properly related to the site, surroundings and envirc
settings, is consistent with the various elements and objectives of the General P

provided and maintained, in that the 30 foot building setback area along El 1
Real area would be heavily landscaped and contain an earthen berm to scr
parking lot from the public roadways. The building perimeter of the mark
store would be screened by trees; the roof would be an earth tone color to
light reflection; and, the roof equipment would be screened to reduce visual
on the homes located to the southeast of the property. The shopping cart
areas at the front of the market/drug store would be screened with walls
truck loading well area would be screened by landscaping and a wall a1
north side of the site. The shopping center would have covered pedestrian w:
in front of the shops and a landscaped pedestrian plaza area located at the cc
the site next to the El Camino Real and La Costa Avenue intersection

4. That the street systems serving the proposed use is adequate to properly handle a
generated by the proposed use, in that the shopping center would have good
vehicular and pedestrian circulation and contain a wide central nom
circulation driveway that would connect with a new signalized intersectio
Costa Avenue and two driveways leading to El Camino Real.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all co:
and modifications to the Site Development Plan document(s) necessary to md
internally consistent and in conformity with final action on the project. Deve
shall occur substantially as shown in the approved Exhibits. Any proposed deve
different fiom this approval, shall require an amendment to this approval.
2. Approval of SDP 97-07 is granted subject to the approval of GPA 97-02, ZC 97
97-09, PUD 97-13, SUP 97-02, CUP 97-03 and SUP 97-03. SDP 97-07 is subjc
conditions and code reminders contained in Planning Commission Resolution P
for the Tentative Map.
3. This approval shall become null and void if building permits are not issued
project within 24 months fiom the date of project approval.
4. If any of the foregoing conditions fail to occur; or if they are, by their term
implemented and maintained over time, if any of such conditions fail to
implemented and maintained according to their terms, the City shall have the
