HomeMy WebLinkAbout1998-07-01; Planning Commission; Resolution 4288L ll 0 0 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 4288 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FROM RESIDENTIAL HIGH DENSITYICOMMERCIAL/OFFICE (RHICIO) TO RESIDENTIAL MEDIUM DENSITY (RM) AND RESIDENTIAL HIGH DENSITY (RH) ON PROPERTY GENERALLY LOCATED EAST OF EL CAMINO REAL, NORTH OF FARADAY AVENUE, AND SOUTH OF THE FUTURE COLLEGE BOULEVARD IN LOCAL FACILITIES MANAGEMENT ZONE 15. CASE NAME: TERRACES AT SUNNY CREEK CASE NO: GPA 96-01 WHEREAS, CanAm Properties, LLC, “Developer”, has filed a application with the City of Carlsbad regarding property owned by CanAm Propertit “Owner”, described as A portion of Lot “B” of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California, per Map thereof No. 823, filed in the Office of the County Recorder of Said County November 16,1896, and Lots 1 through 10 of CT 83-36 per Map No. 11242 as recorded in the Office of the County Recorder of San Diego County, May 23,1985. (“the Property”); and WHEREAS, said verified application constitutes a request for a Genc Amendment as shown on Exhibit(s) “GPA 96-01”, attached, TERRACES AT CREEK, GPA 96-01 as provided in Section 21.52.160 Government Code Section 65.35 seq. of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 3rd day of June 15 day of June 1998, and the 1st day of July 1998, hold a duly noticed public hearing as p by law to consider said request; ~ ‘, . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 WHEREAS, at said public hearing, upon hearing and considering all tt and arguments, if any, of all persons desiring to be heard, said Commission considered a relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad, as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Con RECOMMENDS APPROVAL of TERRACES OF SUNNY CREE& 96-01. Staff is authorized and directed to make, or require Developer to necessary corrections and modifications to the General Plan Amc document(s) necessary to make them internally consistent and in conforn final action on the project, based on the following findings: Findings: 1. The Planning Commission finds that the project, as conditioned herein amendment to the General Plan Land Use Designations as shown on Exhibit GI is in conformance with the Elements of the City’s General Plan, based on the folk a. Land Use Element 1) Goal A.l (Land Use Goals) “A City which preserves and enha environment, character and image of itself as a desirable res beach and open space oriented community.” The proposed will not obstruct open space views from El Camino Real ani designed to take advantage of views into open space to the ear site. 2) Goal A.l (Growth Management and Public Facilities Goals) which ensures the timely provision of adequate public facili services to preserve the quality of life of residents.” The includes provisions which ensure that all necessary public : will be available concurrent with demand. C. Circulation Element 1) Objective B.l (Streets and Traffic Controls) “To provide an 2 circulation infrastructure concurrent with or prior to th demand for such facilities.” This project is conditioned to con fair share of circulation infrastructure as described in the : LFMP. 2) Policy C.l (Streets and Traffic Controls) “To requi development to comply with the adopted Growth Man; performance standards for circulation facilities.” A transp analysis has been prepared for the project which shows the 1 compliance with Growth Management performance Standards 3) Policy C.4 (Alternative Modes of Transportation) - “Link sidewalks to the network of public and private trails system! project provides a linkage for public sidewalks and t surrounding development. 2. That the project will provide sufficient additional public facilities for the dt excess of the control point to ensure that the adequacy of the City’s public facil will not be adversely impacted, in that the Zone 15 LFMP has been amended t the land uses proposed by CT 96-02 and the revisions ensure adequate pro’ public facilities prior to or concurrent with need for all development of the area. 3. That there have been sufficient developments approved in the quadrant at densitic the control point to offset the units in the project above the control point so that g will not result in exceeding the quadrant limit. 4. That all necessary public facilities required by the Growth Management Ordin2 be constructed or are guaranteed to be constructed concurrently with the need created by this project and in compliance with adopted City standards, in that tl 15 LFMP (as amended) contains a phasing plan as well as a facility financi to ensure the coordination of development with the provision of necessac facilities and services.
