PLANNING COMMISSION RESOLUTION NO. 4290
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF SPECIFIC PLAN AMENDMENT NO. 190(B)
TO DELETE THE SPECIFIC PLAN ON PROPERTY
GENERALLY LOCATED AT THE NORTHEAST AND
NORTHWEST CORNERS OF THE INTERSECTION OF EL
CAMINO REAL AND COLLEGE BOULEVARD IN LOCAL
FACILITIES MANAGEMENT ZONE 15.
CASE NAME: TERRACES AT SUNNY CREEK

WHEREAS, CanAm Properties, LLC, “Developer”, has filed a
application with the City of Carlsbad regarding property owned by CanAm Propertie!
“Owner”, described as
A portion of Lot “B” of Rancho Agua Hedionda, in the City of
Carlsbad, County of San Diego, State of California, per Map thereof
No. 823, filed in the Office of the County Recorder of said county,
November 16, 1896, and Lots 11 of CT 83-36 per Map No. 11242 as
recorded in the Office of the County Recorder of San Diego County
May 23,1985.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Specif
Amendment, on file in the Carlsbad Planning Department, TERRACES AT SUNNY CR
SP 190(B), as provided by SP 190 and Government Code Section 65.453 and Chapter 21
21 I/ Carlsbad Municipal Code; and

WHEREAS, at said public hearing, upon hearing and considering all tes

relating to the Specific Plan Amendment; and 28

WHEREAS, on May 1, 1984 , the City Council approved SP190, as c
and conditioned in Planning Commission Resolution No. 2269 and City Council Rt
Ordinance No 9717.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the I
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Cor
RECOMMENDS APPROVAL of TERRACES AT SUNNY CREE
190(B) - repealing the Specific Plan based on the following findings anc
to the following conditions:
Findings:
1. The 39.9 acre site will be regulated by the requirements of the RDM Zone
intended to be developed with residential development as a part of the Terr
Sunny Creek Project.
2. The proposed amendment has been analyzed for environmental impacts in E11
for the Terraces at Sunny Creek project.
3. The proposed development as described by the Specific Plan (SP190(B)) is consiste
the provisions of the General Plan.
4. The proposed plan would not be detrimental to the public interest, health, safety, conv
or welfare of the City, as the General Plan and Zoning proposed will ensure that a(
discretionary safeguards are in place.
5. All necessary public facilities can be provided concurrent with need and adequate prc
have been provided to implement those portions of the capital improvement p
applicable to the subject property.
6. The residential and open space portions of the community will constitute an envirom
sustained desirability and stability, and that it will be in harmony with or provide con
variety to the character of the surrounding area, and that the sites proposed for
facilities, such as schools, playgrounds and parks, are adequate to serve the anti
population and appear acceptable to the public authorities having jurisdiction thereof.
7. The streets and thoroughfares proposed are suitable and adequate to carry the anti1
traffic thereon.

8. Any proposed commercial development can be justified economically at the
proposed and will provide adequate commercial facilities of the types needed at such
proposed.
9. The area surrounding the development can be planned and zoned in coordina,
substantial compatibility with the development.
10. Appropriate measures are proposed to mitigate any adverse environmental impact as
the adopted environmental impact report or negative declaration for the project.
1 1. The proposed plan will contribute to the balance of land use so that local residents n
and shop in the community in which they live.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all COI
and modifications to the Specific Plan document(s) necessary to make them ir
consistent and in conformity with final action on the project. Any proposed deve
different from this approval, shall require an amendment to this approval.
2. Approval of SP 190(B) is granted subject to the approval of EIR 98-01, GPA 96
96-01, LFMP 87-15(B), CT 96-02, SDP 97-02, PUD 96-02, HDP 96-02, SUI
SUP 96-02, and SUP 96-03.
