CASE NAME: MAY SUBDIVISION CASE NO: LCPA 97-12 WHEREAS, California State law requires that the Local Coastal I General Plan, and Zoning designations for properties in the Coastal Zone be in conforma WHEREAS, James & Patricia May, “Developer”, have filed a application for an amendment to the Local Coastal Program designations regarding o:wned by James & Patricia May, “Owner”, described as A portion of Lot “I” of Rancho Agua Hedionda in the County of Sa State of California, according to the map thereof No. 823, filed in the the County Recorder of San Diego County November 16,1896 (“the Property”); and WHEREAS, said verified application constitutes a request for a Loca. Program Amendment as shown on Exhibit “LCPA 97-12” attached hereto and incol by reference for MAY SUBDIVISION, LCPA 97-12 as provided in Public Resourc Section 30574 and Article 15 of Subchapter 8, Chapter 2, Division 5.5 of Title 1 California Code of Regulations of the California Coastal Commission Admi Regulations; and WHEREAS, the Planning Commission did on the 1st day of July, 199 the 15th day of July, 1998 hold a duly noticed public hearing as prescribed by law to said request; and I 4 .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 1 28 ~ i 0 0 WHEREAS, at said public hearing, upon hearing and considering all tc Ad arguments, if any, of all persons desiring to be heard, said Commission considered a: relating to the Local Coastal Program Amendment. i I WHEREAS, State Coastal Guidelines requires a six week public review pt any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1 Commission of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting on 1 1998 and ending on July 1, 1998 staff shall present to the City Cc summary of the comments received. C) That based on the evidence presented at the public hearing, the Con I RECOMMENDS APPROVAL of MAY SUBDIVISION, LCPA 9’ shown on Exhibit “LCPA 97-12”, based on the following finding: Findings: 1.
