CASE NAME: COURTYARD BY MARRIOTT CASE NO: GPA 98-02 WHEREAS, Carlsbad H.H.G.1A.P.M. Hotel Venture L.P., “Develoy filed a verified application with the City of Carlsbad regarding properties owned by C Airport Centre Owners Association and Thomas Hagaman Inc., “Owners”, describec INDUSTRIAL TO OPEN SPACE ON PROPERTIES A portion of lot 26 of Carlsbad Tract No. CT 81-46, Unit 2, according to Map No. 11288, filed in the Office of the County Clerk on July 16, 1985 and a portion of lot 101 of Carlsbad Tract No. 85-24, Unit No. 5, according to Map No. 12815, filed in the Office of the County Clerk on May 16, 1991, all in the City of Carlsbad, County of San Diego, State of California, (“the Properties”); and WHEREAS, said verified application constitutes a request for a gene^ Amendment to exchange open space and planned industrial land use designations on tl Use Map, as shown on Exhibit “X” dated September 2, 1998, attached, COURTYA MARRIOTT, GPA 98-02, as provided in Chapter 21.52 of the Carlsbad Municipal Cod WHEREAS, the Planning Commission did, on the 2nd day of Septembc hold a duly noticed public hearing as prescribed by law to consider said request; WHEREAS, at said public hearing, upon hearing and considering all te; ~ and arguments, if any, of all persons desiring to be heard, said Commission considered al: relating to the General Plan Amendment. > 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 NOW, THEREFORE, BE IT HEREBY RESOLVED by the : Commission of the City of Carlsbad, as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Con RECOMMENDS APPROVAL of COURTYARD BY MARRIOTT, ( 02, exchanging open space and planned industrial land use designal two properties, as shown on Exhibit “X”, dated September 2, 1998, . the following findings and subject to the following conditions: Findings: 1. The proposed amendment to the land use element is consistent with the g( objectives of the various elements of the General Plan in that it assists in and retaining open space while still providing for an orderly balance of land 2. The proposed open space area totals 0.57 acres which is equal to, or greater tl area depicted on the Official Open Space and Conservation Map, as shown on 1 “X”, dated September 2,1998, which also measures 0.57 acres. 3. The proposed open space is of environmental quality equal to, or greater tl depicted on the Official Open Space and Conservation Map, as shown on Exhit dated September 2, 1998, in that the proposed open space contains native whereas the existing open space area in landscaped with an ornamental pale1 16 11 17 18 19 20 21 22 23 24 25 26 27 28 4. The proposed open space, as depicted on the Official Open Space and Conservatj is contiguous, or within close proximity, to open space as shown on the Offic Space Map, since there is Official Open Space and native habitat directly adj the proposed open space. Conditions: 1. Staff is authorized and directed to make, or require the Developer to make, all COJ and modifications to the General Plan Amendment documents necessary to ma internally consistent and in conformity with final action on the project. Deve shall occur substantially as shown in the approved Exhibits. Any proposed deve different from this approval shall require an amendment to this approval. 2.
