DEALERSHIP ON PROPERTY GENERALLY LOCATED ON CAR COUNTRY DRIVE IN LOCAL FACILITIES MANAGEMENT ZONE 3. CASE NAME: HOEHN MOTORS MERCEDES BENZ CASE NO.: CDP 98-33 WHEREAS, Hoehn Group, “Developer”, has filed a verified application CDP 98-33 FOR THE DEVELOPMENT OF AN AUTOMOBILE City of Carlsbad regarding property owned by Hoehn Group, “Owner”, described as Lot 8 and Lot 9 of Carlsbad Tract No. 87-3, in the City of Carlsbad, County of San Diego, State of California, according to map thereof No. 12242, filed in the office of County Recorder of San Diego County, dated October 28,1988. (“the Property”); and WHEREAS, said verified application constitutes a request for a Development Permit as shown on Exhibits “A” - “J”, dated September 16, 1998, on f Planning Department, HOEHN MOTORS MERCEDES BENZ, CDP 98-33, as pro Chapter 2 1.20 1.040 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 16th day of Septemb hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all ts and arguments, if any, of all persons desiring to be heard, said Commission considered a relating to the CDP. Approval of CDP 98-33 is granted subject to the approval of SDP 98-06. CDP subject to all conditions contained in Planning Commission Resolution No. SDP 98-06. NOTICE Please take NOTICE that approval of your project includes the “imposition” dedications, reservations, or other exactions hereafter collectively referred to for conver “fees/exactions.” You have 90 days from September 16, 1998, to protest imposition of these fees/exaction: protest them, you must follow the protest procedure set forth in Government Code 66020(a), and file the protest and any other required information with the City Mar processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure t follow that procedure will bar any subsequent legal action to attack, review, set aside, annul their imposition.
