A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF COASTAL DEVELOPMENT PERMIT, CDP
98-44, TO ALLOW THE CONSTRUCTION OF A THREE
STORY MULTI-TENANT OFFICE BUILDING CONTAINING
42,960 SQUARE FEET OF BUILDING AREA ON PROPERTY
GENERALLYLOCATEDONTHENORTHEASTCORNEROF
ARMADA DRIVE AND FLEET STREET IN LOCAL
FACILITIES MANAGEMENT ZONE 13.

WHEREAS, DCM Properties, Inc. , “Developer”, has filed a verified aF
with the City of Carlsbad regarding property owned by Carlsbad Ranch Cornpal
“Owner”, described as
CENTER
Lot 15 of Carlsbad Tract No. 94-09, Carlsbad Ranch Units 2 &
3 per Map No. 13408, filed April 1, 1997, in the Office of the
County Recorder, as file No. 1997-147754, in the City of
Carlsbad, County of San Diego, State of California
(“the Property”); and
WHEREAS, said verified application constitutes a request for a
Development Permit as shown on Exhibits “A” - “I” dated October 7, 1998, on fi
Planning Department, CARISBAD RANCH CORPORATE CENTER, CDP 5
provided by Chapter 2 1.20 1.040 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 7th day of October 15
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all tc
and arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the CDP.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the COI
RECOMMENDS APPROVAL of CARLSBAD RANCH COR€
CENTER, CDP 98-44 based on the following findings and subjel
following conditions:
Findingg:
1. That the proposed development is in conformance with the Certified Local
Program and all applicable policies in that the project is in compliance 1
relevant policies of the Mello I1 Segment of the Local Coastal Progr:
Carlsbad Ranch Specific Plan which serves as partial implementation for tl
I1 Segment for the project site, and the Coastal Resource Protection Overl,
The project site contains no coastal resources and is an existing graded devt
lot created pursuant to a prior Coastal Development Permit.
2. The project complies with the requirements of the Coastal Resource PI
Overlay Zone as the project site has been previously graded pursuant to thl
Tentative Map (CT 94-09) for the Carlsbad Ranch. No sensitive vegetation
the project site. Drainage facilities to remove pollutants from site runoff
provided.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all co
and modifications to the document(s) necessary to make them internally consiste
conformity with final action on the project. Development shall occur substar
shown in the approved Exhibits. Any proposed development different 6
approval, shall require an amendment to this approval.
2. The applicant shall apply for and be issued building permits for this pr
within two (2) years of approval or this coastal development permit will e:
unless extended per Section 21.201.210 of the Zoning Ordinance.
3. Approval of CDP 98-44 is granted subject to the approval of SDP 98-11. CDP 9
is granted subject to all conditions contained in the Planning Commission Resol:
