PLANNING COMMISSION RESOLUTION NO. 4400
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
COASTAL DEVELOPMENT PERMIT NO. CDP 98-42 FOR
THE DEVELOPMENT OF 44 SINGLE-FAMILY HOMES ON
PREVIOUSLY SUBDIVIDED LOTS AND TO ALLOW MINOR
LOT GRADING AND RETAINING WALLS ASSOCIATED
WITH THE EXPANSION OF THE PAD AREAS OF SOME OF
GENERALLY LOCATED WEST OF AVIARA PARKWAY
BETWEEN CAMINO DE LAS ONDAS AND PLUM TREE
ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 20.

WHEREAS, Pacific Heritage Development, “Developer”, has filed a
application with the City of Carlsbad regarding property owned by Pacific 1
Development, “Owner”, described as
THE APPROVED SINGLE-FAMILY LOTS ON PROPERTY
Lots No. 1-36 and 112-119 of Carlsbad Tract No. 92-02, in the
City of Carlsbad, County of San Diego, State of California,
according to map thereof No. 13378, filed in the office of
County Recorder of San Diego County, dated December 9,
1996.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a
Development Permit as shown on Exhibits “A” - “X” dated October 7, 1998, on fi
Planning Department, SEASIDE ESTATES, CDP 98-42 as provided by Chapter 21.20
the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 7th day of October 15
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all tc
and arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the CDP.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Cor,
APPROVES SEASIDE ESTATES, CDP 98-42 based on the following
and subject to the following conditions:
Findings:
1. That the proposed development is in conformance with the Mello I1 segmer
Certified Local Coastal Program (LCP) and all applicable policies in
development does not obstruct public views of significant coastal resources
agricultural activities, sensitive coastal resources, geologic instability or
access opportunities exist on or adjacent to the project site. The st
placement and architecture of the single-family homes is consistent I
applicable One Family Residential Zone (R-1-10000-Q) and Specific Plan 21
proposed minor lot grading into existing manufactured slopes for purl
increasing the rear pad areas for some of the lots is not subject to th
Preservation policies of the Mello I1 LCP. No sensitive coastal resources
impacted by the proposed minor grading and adequate drainage and
control measures have been incorporated into the project.
2. The project site is located in the Coastal Agriculture Overlay Zone, ~CCOI
Map X of the Land Use Plan, certified September, 1980. The project is cc
with the overlay zone in that all required agricultural mitigation fees have bc
as part of Carlsbad Tract 92-02(A) in accordance with the provisions of the
zone.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all COI
and modifications to the document(s) necessary to make them internally consistel
conformity with final action on the project. Development shall occur substar
shown in the approved Exhibits. Any proposed development different fi
approval, shall require an amendment to this approval.
2. The applicant shall apply for and be issued building permits for this prc
within two (2) years of approval or this coastal development permit will ex
unless extended per Section 21.201.210 of the Zoning Ordinance.
3. Approval of CDP 98-42 is granted subject to the administrative approval of SDF
06(E) and HDP 92-03(C).
