A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION ON
PROPERTY GENERALLY LOCATED WEST OF CANNON
ROAD AT FARADAY AVENUE IN LOCAL FACILITIES
MANAGEMENT ZONE 8.
CASE NAME: AGUA HEDIONDA VISITOR/NATURE
CASE NO: PCD 98-01
WHEREAS, The Agua Hedionda Lagoon Foundation , “Developer”,
a verified application with the City of Carlsbad regarding property owned by Kel
Company, “Owner7’, described as
CENTER
That portion of Lot “I” of Rancho Agua Hedionda and that
portion of Lot “F” of Rancho Agua Hedionda, in the City of
Carlsbad, County of San Diego, State of California, according
to map thereof No. 823, filed in the office of the County
Recorder of San Diego County, November 16,1896.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a
Commission Determination as shown on Exhibit(s) “A”-“D” dated October 7, 1998, (
the Planning Department AGUA HEDIONDA VISITORLNATURE CENTER, PC
and Chapter 18.24 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 7th day of Octobr
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testim
arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the :
Commission as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, the Commission API:

following findings and subject to the following conditions:
Findings:
1. Relocation of the structure will not adversely affect the public's genera
safety and welfare.
Conditions:
1. A building permit issued by the City is required prior to moving the structu~
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on the 7th day of October 199;
following vote, to wit:
