A RESOLUTION OF THE PLANNING COMMISSION OF THE
MITIGATED NEGATIVE DECLARATION AND MITIGATION
MONITOFUNG AND REPORTING PROGRAM TO ALLOW
FOR THE WIDENING OF EL CAMINO REAL LOCATED
BETWEEN COLLEGE BOULEVARD AND TAMARACK
AVENUE AT CANNON ROAD IN LOCAL FACILITIES
MANAGEMENT ZONE 8.

WHEREAS, the City of Carlsbad, “Developer”, has filed a verified ay
regarding property which consists of El Camino Real Right-of-way (“the Property”);
WHEREAS, the Planning Commission did on the 4th day of Novemb

WHEREAS, at said public hearing, upon hearing and considering all tc

NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the 1
Commission hereby APPROVES the Mitigated Negative Declarat
Mitigation and Monitoring, Reporting Program according to Exhibit “NI
September 25, 1998, and “PII” dated September 22, 1998, attached he
made a part hereof, based on the following findings:

1. The Planning Commission of the City of Carlsbad has reviewed, analyzed and consid

and said comments thereon, and the Mitigation Monitoring and Reporting Program, c

2. The Planning Commission does hereby find that the Mitigated Negative Declara
Mitigation Monitoring and Reporting Program have been prepared in accordal
requirements of the California Environmental Quality Act, the State Guidelines
Environmental Protection Procedures of the City of Carlsbad.
3. The Planning Commission finds that the Mitigated Negative Declaration ref
independent judgment of the Planning Commission of the City of Carlsbad.
Conditions:
1. The project is subject to the mitigation measures listed in the Environmental
Assessment Part I1 for the El Camino Real Widening project dated September
and the Developer shall implement, or cause the implementation of, the
Mitigation Monitoring and Reporting Program.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Commission of th'e City of Carlsbad, California, held on the 4th day of November 199
