CASE NAME: POINSETTIA PROPERTIES PLANNING CASE NO.: CDP 98-38 WHEREAS, HSL/BP Michan, L.P., “Owner” and “Developer”, ha AREA 5 verified application with the City of Carlsbad regarding property described as Portions of the east half of Section 29 and the west half of Section 28, Township 12 south, Range 4 west, San Bernardino Base and Meridian, in the City of Carlsbad, County of San Diego. (“the Property”); and WHEREAS, said verified application constitutes a request for a Development Permit as shown on Exhibits “A” - “M” dated March 17, 1999,on fi Planning Department, POINSETTIA PROPERTIES PLANNING AREA 5, CDP ! provided by Chapter 21.201.040 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 17th day of March 15 a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all tc and arguments, if any, of all persons desiring to be heard, said Commission considered a1 relating to the CDP. B) That based on the evidence presented at the public hearing, the COI RECOMMENDS APPROVAL of POINSETTIA PROPERTIES PLr AREA 5, CDP 98-38, based on the following findings and subjel following conditions: FindinEs: 1.
