A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CHANGE TO FORMALLY
ESTABLISH THE COMMERCIALNISITOR-SERVING OVER-
LAY ZONE ON PROPERTY LOCATED AS SHOWN ON THE
REVISED ZONING MAP.
CASE NAME: COMMERCIALNISITOR-SERVING
OVERLAY ZONE
CASE NO: ZC 99-03
WHEREAS, the City of Carlsbad has initiated this zone change to e:
CommerciaWisitor-Serving Overlay Zone in the City;
WHEREAS, a verified application has been filed with the City of Caj
implement the new overlay zone regulations for properties included wit
configuration and coverage of the overlay zone to be reflected on the City’s Zoning
WHEREAS, said application constitutes a request for a Zone Change as Si
Exhibit ZC 99-03 attached to the draft City Council Ordinance, Exhibit “Y” dated Marc
1999, and attached hereto, COMMERCIALNISITOR-SERVING OVERLAY ZONE
03 as provided by Chapter 21.52 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 17th day of March, 19
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all te
and arguments, if any, of all persons desiring to be heard, said Commission considered a1
relating to the Zone Change; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the I

CARLSBAD, CALIFORNIAy AMENDING THE ZONING MAP
TO REFLECT THE ESTABLISHMENT OF THE COMMER-
CIALNISITOR-SERVING OVERLAY ZONE

CASE NO.: ZC 99-03
The City Council of the City of Carlsbad, California, does ordain as follol
SECTION 1 : Title 21 of the Carlsbad Municipal Code is amendec
amendment of the Zoning Map by the addition of the CommerciaWisitor-Serving Over
on property as shown on the exhibit marked ZC 99-03, attached hereto and made a part h
EFFECTIVE DATE: This ordinance shall be effective thirty days
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause
published at least once in a publication of general circulation in the City of Carlsbac
fifteen days after its adoption. (Not withstanding the preceding, this ordinance shal
effective within the City’s Coastal Zone until approved by the California Coastal Commis
