A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LAND USE
ELEMENT OF THE GENERAL PLAN ON PROPERTY
GENERALLY LOCATED SOUTH OF PARK DRIVE, NORTH
OF VETERANSy MEMORIAL PARK, WEST OF EL CAMINO
REAL IN LOCAL FACILITIES MANAGEMENT ZONE 8.

WHEREAS, Kelly Land Company, “Developer”, has filed a verified apl
with the City of Carlsbad regarding property owned by the Kelly Land Company a1
Homes Limited Partnership, “Owner”, described as
A portion of Lot “I” of Rancho Agua Hedionda and a portion
of Lot “F” of Rancho Agua Hedionda, all in the City of
Carlsbad, County of San Diego, State of California, according
to map thereof No. 823, filed in the office of the County
Recorder of San Diego on November 16,1896
(“the Property”); and
WHEREAS, said application constitutes a request to amend the Land USI
of the Land Use Element of the General Plan for certain properties from RM to RLR
to RMH, T-R to N, RMH to OS, OS to RMH, and OS to RLM; and
WHEREAS, the recommended amendment to the General Plan La
Map is as shown on Exhibit “GPA 97-07 “ dated April 7, 1999, attached hereto E
RANCH, GPA 97-07, all as provided in Section 21.52.160 Government Code Section
and et. seq. of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 7th day of April 1999
duly noticed public hearing as prescribed by law to consider said request;

WHEREAS, at said public hearing, upon hearing and considering all tt
and arguments, if any, of all persons desiring to be heard, said Commission considered a:
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the i
Commission of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Con
RECOMMENDS APPROVAL of KELLY RANCH, GPA 97-07, base
following findings:
Findings:
1. That the proposed amendments to the Land Use Element of the General P1:
RM to RLM and RMH as modified will result in an overall reduction
allowable residential density within the project area and will therefc
compromise the City’s Growth Management Ordinance.
2. That the proposed change from RM to RMH is appropriate in that the
density is located adjacent to a circulation element roadway and close
employment centers of the Industrial corridor.
3. That the proposed change from RM to RLM as modified is appropriate in 1
lower density designations are located within areas of moderate topographJ
limits access and the net area of development. ~
4. That the proposed change from T-R to 0 and OS will effectively reduce
intensity of Area “F” which has limited developable area and is adjacel
significant sensitive biological resource.
5. That the proposed open space area as modified is equal to or greater than f
depicted on the Official Open Space and Conservation Map.
6. That the proposed open space area as modified is of environmental quality equ
greater than that depicted on the Official Open Space and Conservation Map.
7. That the proposed open space as modified is contiguous or within close proxi
open space as shown on the Official Open Space and Conservation Map

Condition
1. Approval of GPA 97-07 is granted subject to the approval of ZC 97-07, ME
LCPA 97-09, and ZCA 99-03.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on the 7th day of April 1991
following vote, to wit:
AYES: Chairperson Heineman, Commissioners Compas, L’Heurel
Savary, and Segall
