CASE NAME: ALGA ROAD - COX COMMUNICATIONS CASE NO: SUP 99-02 WHEREAS, Cox Communications PCS, LP, “Developer”, has filed a g application with the City of Carlsbad regarding property owned by West Bluff Associat 10 A Utah partnership, “Owner”, described as 11 12 13 A portion of Parcel 2 of Parcel Map No. 9043, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, August 14,1979, as file no. 79-304715 of official records. ~ l4 (‘the Property”); and 15 16 17 18 19 the Carlsbad Municipal Code; and WHEREAS, said verified application constitutes a request for a Spec Permit as shown on Exhibit(s) “A”-“C” dated April 7,1999, on file in the Planning Dep ALGA ROAD - COX COMMUNICATIONS, CUP 98-19, as provided by Chapter 2 20 WHEREAS, the Planning Commission did on the 7th day of April, 1995 21 duly noticed public hearing as prescribed by law to consider said request; and 22 ll WHEREAS, at said public hearing, upon hearing and considering all tes 23 II and arguments, if any, of all persons desiring to be heard, said Commission considered all relating to the Special Use Permit; 24 25 26 Commission of the City of Carlsbad as follows: 27 NOW, THEREFORE, BE IT HEREBY RESOLVED by the PI 28 A) That the foregoing recitations are true and correct. The project complies with the requirements of the El Camino Real 1 Development Standards in that the architectural dormer element conforr Old California Style and will not adversely impact the scenic quality of the ( Conditions: 1. Staff is authorized and directed to make, or require Developer to make, all c( and modifications to the Special Use Permit document(s) necessary to m; internally consistent and in conformity with final action on the project. Dev shall occur substantially as shown in the approved Exhibits. Any proposed dev different fkom this approval, shall require an amendment to this approval. 2. Approval of SUP 99-02 is granted subject to the approval of CUP 98-19. SUP subject to all conditions contained in Planning Commission Resolution No. 44’ Conditional Use Permit.
