A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF SPECIFIC PLAN AMENDMENT NO. SP23(H)
ON PROPERTY GENERALLY LOCATED AT THE
SOUTHWEST CORNER OF PASEO DEL NORTE AND
CAMNO DEL PARQUE IN LOCAL FACILITIES
MANAGEMENT ZONE 4.

WHEREAS, the City of Carlsbad has initiated an application for a
Plan Amendment regarding property owned by Carlsbad Corporate, LLC, ‘
described as
Parcel 3 of Parcel Map No. 3415, in the City of Carlsbad,
County of San Diego, State of California, filed in the office of
the County Recorder of San Diego County, January 21,1975 a
file No. 75-014212 of official records.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Spec
amendment, Specific Plan Amendment SP 23(H) as provided by SP 23 and Chapter
the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 7th day of April 1991
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all tt
and arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the Specific Plan amendment; and
WHEREAS, SP 23 was adopted by City Council Ordinance No. !
March 7,1972; and amended most recently by City Council on January 6,1998, S
as described and conditioned in Ordinance NS-437 and Planning Commission Re
No. 4184.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Cor
RECOMMENDS ADOPTIONy of draft City Council Ordinance att
Exhibit “X” APPROVING an amendment to SP 23 CAE
CORPORATE PLAZA, SP 23(H), based on the following findings an
to the following conditions:
Findinm:
1. The Planning Commission finds that the project, as conditioned herein for SP
in conformance with the City’s General Plan, because the proposed land 1
contribute to the balance of land use so that local residents may work in the corn
which they live.
2. The proposed plan amendment will not be detrimental to the public interesl
safety, convenience or welfare of the City.
3. The proposed uses will be appropriate in location to the purpose intended. TI

3. The development standards for the Carlsbad Corporate Plaza site arc
established as those found in Section 21.34.070 of the Carlsbad Municip
Any change to the buildings or site plan as shown on exhibits “A” - “I

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ADOPTING THE CARLSABD
CORPORATE PLAZA SPECIFIC PLAN AMENDMENT RELATIVE
TO ALLOWED USES AND DEVELOPMENT STANDARDS ON
PROPERTY GENERALLY LOCATED‘ SOUTH OF PASEO DEL
NORTE AND WEST OF CAMINO DEL PARQUE IN LOCAL
FACILITIES MANAGEMENT ZONE 3.

WHEREAS, the City Council of the City of Carlsbad, California has revic
considered a Specific Plan Amendment to establish allowed uses and development I
for the site; and
WHEREAS, SP 23 was adopted by City Council Ordinance No. 9293 c
07, 1972, and constitutes the zoning for the subject property; and
WHEREAS, SP 23 has been amended a total of seven times since
adoption, most recently for SP 23(G) through City Council Ordinance No. NS-437 on D
16,1998; and
WHEREAS, after procedures in accordance with requirements of the
City Council has determined that the public interest indicates that said plan amend
approved.
NOW, THEREFORE, the City Council of the City of Carlsbad, Califorr
ordain as follows:
SECTION I: That SP 23 as amended to date is further amended
Specific Plan Amendment relative to the Carlsbad Corporate Plaza Exhibit “A”, dated
1999, attached hereto and incorporated by reference herein, is approved. The Spec
Amendment shall constitute the zoning for this property and all development and us
property shall conform to the plan.
SECTION II: That the findings and conditions of the Planning Commit
set forth in Planning Commission Resolutions No. 4517 shall also constitute the findi

SECTION II: That the findings and conditions of the Planning Comm
set forth in Planning Commission Resolutions No. 4517 shall also constitute the finc
conditions of the City Council.
EFFECTIVE DATE: This ordinance shall be effective thirty days
adoption, and the City Clerk shall certify to the adoption of this ordinance and causc
published at least once in a publication of general circulation in the City of Carlsb;
fifteen days after its adoption. (Not withstanding the preceding, this ordinance sha
effective within the City’s Coastal Zone until approved by the California Coastal Commi.

The intent and purpose of the Specific Plan is to provide an area of low-intensity business
and professional offices which are in operation during standard business hours, 8 a.m. to
5 p.m. Monday through Friday, are not dependent on either street or freeway frontage for
signage identification, and usually limit client visits through appointments.

Other uses similar to those listed above which the Planning Director may determine to
fall within the intent and purposes of this Specific Plan, are of comparable nature, and
