A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CHANGE FROM LIMITED
CONTROL TO ONE FAMILY RESIDENTIAL ON PROPERTY
GENERALLY LOCATED WEST OF BLACK RAIL ROAD
AND NORTH OF AVIARA PARKWAY IN LOCAL
FACILITIES MANAGEMENT ZONE 20.

CASE NO: ZC 98-1 1
WHEREAS, Spectrum Communities, L.L.C., “Developer”, has filed
application with the City of Carlsbad regarding property owned by Carnation Pr
“Owner”, described as
The southeast quarter of the southeast quarter of the southwest
quarter of section 22, township 12 south, range 4 west, San
Bernardino Base and meridian, in the City of Carlsbad,
County of San Diego, State of California.
(“the Property”); and
WHEREAS, said application constitutes a request to change the zonj
Limited Control to One Family Residential; and
WHEREAS, the amendment to the Zoning map is set forth in the d
Council Ordinance, Exhibit “X”, dated May 5, 1999, attached hereto, CARh
PROPERTIES ZC 98-1 1, as provided by Chapter 21.52 of the Carlsbad Municipal Cod
WHEREAS, the Planning Commission did on the 5th day of May, 199!
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all tc
and arguments, if any, of all persons desiring to be heard, said Commission considered a1
relating to the Zone Change; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1
Commission as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the COI
RECOMMENDS APPROVAL of CARNATION PROPERTY Z(
based on the following findings:

Findinys:
1. That the proposed Zone Change from Limited Control to One Family Resic
consistent with the goals and policies of the various elements of the General PI2
the General Plan designates the property as suitable for single family rc
development in the Land Use Element.
2. That the Zone Change will provide consistency between the General Plan and i
mandated by California State law and the City of Carlsbad General Plan L
Element, in that the General Plan designates the property as suitable for sing
residential development in the Land Use Element.

The City Council of the City of Carlsbad, California, does ordain as folk
SECTION I: That the zoning map is hereby amended as shown on Er
