HomeMy WebLinkAbout1999-05-19; Planning Commission; Resolution 4553n 0 0 li 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 4553 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE PERMIT AMENDMENT TO CONSTRUCT A FOUR BUILDING INDUSTRIAL CAMPUS ON PROPERTY GENERALLY LOCATED EAST OF EL CAMINO REAL AND SOUTH OF FARADAY AVENUE IN LOCAL FACILITIES MANAGEMENT ZONE 5 CASE NAME: CARLSBAD CORPORATE CENTER CASE NO: SUP 97-05CA) 8 9 10 11 WHEREAS, MSGW California 11, L.L.C., a Delaware limited company, “Developer”, has filed a verified application with the City of Carlsbad I property owned by Beckman Instruments, Inc., “Owner”, described as 12 13 Parcel 2 of Parcel Map 13958, in the City of Carlsbad, County of San Diego, State of California, as filed in the Office of the County Recorder of San Diego County, September 18,1985 as file no. 85-344096 14 15 16 Permit Amendment as shown on Exhibit(s) “A” - “Y” dated May 19, 1999, on fi 17 WHEREAS, said verified application constitutes a request for a Spc l8 Planning Department CARLSBAD CORPORATE CENTER, SUP 97-05(A), as pro 19 the conditions of approval of SUP 97-05 and Chapter 21.40/21.110 of the Carlsbad r\ 20 (‘the Property”); and 21 /I Code; and 22 WHEREAS, the Planning Commission did on the 19th day of May, 191 23 WHEREAS, at said public hearing, upon hearing and considering all t 24 duly noticed public hearing as prescribed by law to consider said request; and 25 26 and arguments, if any, of all persons desiring to be heard, said Commission considered 2 ll relating to the Special Use Permit Amendment; 27 28 WHEREAS, on December 17, 1997, the Planning Commission appro’ 97-05 , as described and conditioned in Planning Commission Resolution No. 4206. B) That based on the evidence presented at the public hearing, the Cor APPROVES CARLSBAD CORPORATE CENTER, SUP 97-05(A), the following findings and subject to the following conditions: F’indinp: 1. The project is consistent with the El Camino Real Corridor Development SI in that the one common characteristic that melds the various componen corridor in this area is a “campus” look which the project promotes. Thc meets or exceeds all development standards identified for this area as th theme is a planned campus type, the buildings height does not exceed 35 ft is no cut or fill exceeding 15 feet, the setback from the roadway exceeds 30 there is no change from the Land Use Plan. Conditions: 1. Approval of SUP 97-05(A) is granted subject to the approval of SDP 97-08(A). 05(A) is subject to all conditions contained in SDP 97-08(A) for the Site Dew Plan. 2. Approval of SUP 97-05(A) supplements the approval of SUP 92-05. All c( of approval found in Planning Commission Resolution 4206, dated Dece~ 1997 remains in full force and effect except as modified herein. 3. The buildings fronting on El Camino Real shall be allowed one free monument sign per building. Monument signs shall not exceed five feet aba grade, as measured from the center line, and not exceed 24 square feet in 2 wall signs shall be permitted on Buildings “A9’, “B”, or “C”, except for building identification such as building address. Any signs proposed development shall require review and approval of the Planning Director installation of such signs. Failure follow that procedure will bar any subsequent legal action to attack, review, set aside annul their imposition. You are hereby FURTHER NOTIFIED that your right to protest the specified fees/ DOES NOT APPLY to water and sewer connection fees and capacity charges, nor zoning, grading or other similar application processing or service fees in connection project; NOR DOES IT APPLY to any fees/exactions of which you have previously bl a NOTICE similar to this, or as to which the statute of limitations has previously I expired.
