A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
MITIGATED NEGATIVE DECLARATION AND MITIGATION
MONITORING AND REPORTING PROGRAM TO ALLOW
IMPROVEMENTS TO THE EXISTING SEWER PUMP
STATION ON PROPERTY LOCATED NORTH OF LA COSTA
AVENUE AND WEST OF SAXONY ROAD IN LOCAL
FACILITIES MANAGEMENT ZONE 19

WHEREAS, Leucadia County Water District, “Owner” and “Develo

filed a verified application with the City of Carlsbad regarding property described as

(“the Property”); and
WHEREAS, a Mitigated Negative Declaration and Mitigation Mc
and Reporting Program was prepared by the Leucadia County Water District in co:
with said project; and
WHEREAS, the Leucadia County Water District (the lead agency) dl
15th day of July, 1998, hold a duly noticed public hearing as prescribed by law to
said request and passed and adopted Resolution No. 2070 approving a Mitigated
Declaration and Mitigation Monitoring and Reporting Program; and
WHEREAS, the Planning Commission did on the 2nd day of June, 199
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all t

submitted by staff, and considering any written comments received, the Planning Coj
considered all factors relating to the Mitigated Negative Declaration and IV
Monitoring and Reporting Program.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the
Commission hereby APPROVES the Mitigated Negative Declara
Mitigation Monitoring and Reporting Program according to Attacl
and 5 dated July 15,1998, attached to the Staff Report dated June 2,
made a part hereof, based on the following findings:
Findinqs:
1. The Planning Commission of the City of Carlsbad has reviewed, anal
considered the Mitigated Negative Declaration and the Mitigation Monitc
Reporting Program approved by the Leucadia County Water District on
1998, the environmental impacts therein identified for this project and said c
thereon, on file in the Planning Department, prior to approving the prc
Planning Commission finds that there is no substantial evidence the prc
have a significant effect on the environment and hereby APPROVES the :
Negative Declaration.
2. Based on the findings and conclusions stated in the Mitigated
Declaration and the Mitigation Monitoring and Reporting Program, th
substantial evidence that the Project, as mitigated, will have any 1
significant adverse effect on the environment in that:
0 No long term adverse impacts to local waters are anticipated as I
are incorporated into the project which reduce effects associated
potential discharge of sediments and dewatering activities
Batiquitos Lagoon
0 The proposed improvements would not affect vehicle, bic
pedestrian traffic on La Costa Avenue since the improvem
outside the right-of-way and access to the site is by a cc
intersection.

0 The impacts to the biological habitat will be mitigated off-sit
acquisition of .OS acres of coastal sage scrub and the revegetatii
acres of southern willow scrub/mule fat scrub.
0 Noise mitigation has been incorporated into the constructio~
emergency generator facility to a level of 60 dB or less to the
biological habitat area.
3. The Planning Commission does hereby find that the Mitigated Negative Dt
and Mitigation Monitoring and Reporting Program approved by the I
County Water District have been prepared in accordance with requiremer
California Environmental Quality Act, the State Guidelines and the Envirc
Protection Procedures of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on the 2nd day‘ of June 199!
following vote, to wit:
