CASE NAME: RANCHO CARRILLO VILLAGE “P CASE NO.: PUD 97-03(A) PERMIT, PUD 97-03, FOR THE DELAYED ARCHITECTURAL PLANS OF 56 SINGLE-FAMILY HOMES ON PROPERTY 10 WHEREAS, Continental Ranch Inc., “Owner” and “Developer”, ha; 11 verified application with the City of Carlsbad regarding property described as: 12 13 14 A portion of sections 18 and 19, township 12 south, range 3 west, San Bernardino base and meridian, according to the official plat thereof, in the City of Carlsbad, County of San Diego, State of California. 15 16 (“the Property”); and l8 Development Amendment as shown on Exhibits “A” - “L” dated July 7, 1999, on fi: 17 WHEREAS, said verified application constitutes a request for a Planr Planning Department, RANCHO CARRILLO VILLAGE “P” - PUD 97-03(A), as pro’ 19 20 21 Chapter 21.45 of the Carlsbad Municipal code; and WHEREAS, the Planning Commission did, on the 7th day of July, 199! duly noticed public hearing as prescribed by law to consider said request; and 22 23 WHEREAS, at said public hearing, upon hearing and considering all te 24 25 described and conditioned in City Council Resolution No. 98-348. 27 WHEREAS, on October 20, 1998, the City Council approved PUD 5 26 relating to the Planned Unit Development Permit Amendment. and arguments, if any, of persons desiring to be heard, said Commission considered a1 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad, California, as follows: A) The foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Cor determines that the Amendment is Minor in nature and APE RANCHO CARRILLO VILLAGE “P” - PUD 97-03(A), based following findings and subject to the following conditions. Findinm: 1. All findings set forth in Planning Commission Resolution No. 4386 apply equal1 amended project, and are incorporated by this reference. 2. The proposed Amendment qualifies as, and is hereby found to be, a Minor Development Amendment because: A) The amendment does not involve a change to the densities or bounc the subject property; B) The amendment does not involve an addition of a new use or group not shown on the original permit, or the rearrangement of uses wi development in that the minor amendment consists only of archi review of the building elevations and floor plans of single family homf C) The amendment does not involve changes greater than ten pel approved yards, coverage, height, open space or landscaping. 3. The building architecture is consistent with the Village “P” Design Guide established by PUD 97-03. 4. The amendment meets all applicable design criteria set forth in the Villr Design Guidelines in that it is compatible with other development within the Carrillo Master Plan. 5. The Planning Director has found that this Subsequent Project was described previous Environmental Impact Report prepared for MP 139(F); and there will additional significant effects, not analyzed therein; and that no new or ad mitigation measures or alternatives are required; and that, therefore, this Sub Project is within the scope of the prior EIR; and no new environmental docurr Public Resources Code 21 083 findings are required. 6. Staff is authorized and directed to make, or require the Developer to make, all co and modifications to the Planned Unit Development documents, as necessary them internally consistent and in conformity with final action on the Development shall occur substantially as shown in the approved Exhibits. Any development different from this approval, shall require an amendment to this app 2. All other conditions and approvals of PUD 97-03 as stated in Planning Con Resolution No. 4386 not amended by this action shall remain in full force an 3. The Developer shall comply with all applicable provisions of federal, state, E ordinances in effect at the time of permit issuance. 4. The Developer shall include, as part of the plans submitted for any permit plan reduced legible version of the approving Resolutions No. 4386 and 4588 on a 2 blueline drawing. 5. Building permits will not be issued for development of the subject property u District Engineer determines that sewer facilities are available at the time of ap for such sewer permits and will continue to be available until time of occupancy. 6. This project shall comply with all conditions and mitigation measures which are as part of the approved Planned Unit Development, as contained in Planning Con Resolution No. 4386. General 7. If any of the foregoing conditions fail to occur; or if they are, by their term implemented and maintained over time, if any such conditions fail to be so imp1 and maintained according to their terms, the City shall have the right to revoke 01 all approvals herein granted; deny, or fwther condition issuance of all future permits; deny, revoke or further condition all certificates of occupancy issued u authority of approvals herein granted; institute and prosecute litigation to corn compliance with said conditions or seek damages for their violations.
