PLANNING COMMISSION RESOLUTION NO. 4624
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT FOR THE UPGRADE OF THE
EXISTING FOXES LANDING LIFT STATION AND
CONSTRUCTION OF A NEW OPERATIONS/CONTROL
BUILDING NORTH OF SNUG HARBOR AND AGUA
HEDIONDA LAGOON ON THE EAST SIDE OF THE 1-5
FREEWAY IN LOCAL FACILITIES MANAGEMENT ZONE 1.
CASE NAME: FOXES LANDING SEWER LIFT UPGRADE
CASE NO.: CUP 99- 10
WHEREAS, the City of Carlsbad, “Developer” and “Owner”, has
verified application with the City of Carlsbad regarding property described as
A portion of Tract Map 238, Thum Lands as recorded on
December 9, 1915. The site is accessed via the southern
terminus of Harrison Street.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Conditi.
Permit as shown on Exhibit(s) “A” - “B” dated August 18, 1999, on file in the (
Planning Department, FOXES LANDING SEWER LIFT UPGRADE, CUP 91
provided by Chapter 21.42 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 18th day of August 14
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all tc
and arguments, if any, of all persons desiring to be heard, said Commission considered a,
relating to the CUP.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Con
APPROVES FOXES LANDING SEWER LIFT UPGRADE, CUI
based on the following findings and subject to the following conditions:

1. That the requested use is necessary or desirable for the development of the corn

2. Prior to approval of the building permit, the Developer shall apply for and
