I t 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 4621 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A DEVELOPMENT ON PROPERTY GENERALLY LOCATED ADJACENT TO EL CAMINO REAL JUST SOUTH OF CASSIA ROAD IN LOCAL, FACILITIES MANAGEMENT ZONES 21 AND 10 CASE NAME: MANZANITA APARTMENTS CASE NO: SUP 98-06 SPECIAL USE PERMIT FOR A 157-UNIT APARTMENT WHEREAS, Manzanita Partners, LLC, “Developer”, has filed a application with the City of Carlsbad regarding property owned by Bons Revocabl Trust and Manzanita Partners, LLC, “Owners”, described as a portion of the NE and SE ?4 of the SW ?4 of Section 23, T12S, R4W, SBM, County of San Diego (‘the Property”); and WHEREAS, said verified application constitutes a request for a Spc Permit as shown on Exhibit(s) “A” - “X” dated September 15, 1999, on file in the Department MANZANITA APARTMENTS, SUP 98-06, as provided by Chapter 21.4 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 15th day of Septemb hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all 1 and arguments, if any, of all persons desiring to be heard, said Commission considered : relating to the Special Use Permit; NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Co APPROVES of MANZANITA APARTMENTS, SUP 98-06, base following findings and subject to the following conditions: E c 1 2 3 4 5 6 7 8 9 10 11 12 13 14 0 0 Findinw : 1. That the proposed project has been designed to comply with the SI contained in the El Camino Real Corridor Development Standards, in project is designed with craftsman style architecture, has a maximum height of 35 feet or less, incorporates a 30-foot setback from the right-of-1 and will include no visible roof equipment. 2. That compliance with the El Camino Real Corridor Development Standard grading changes to a maximum of 10 feet from existing grade is infeasibl proposed project, in that the project must provide full-width improvemen Camino Real and the project site contains steep slope areas near the road1 that the resulting grade change in some areas will be up to 13’4” from grade. 3. That the scenic qualities of the El Camino Real Scenic Corridor will conti] maintained even though the grading standard is not strictly fulfilled, in grading change will be limited to the amount necessary to provide the roadway improvements. 4. Approval of SUP 98-06 is granted subject to the approval of the Mitigated Declaration and Mitigation Monitoring and Reporting Program and Z LCPA 98-06, SDP 98-19, HDP 98-18, and CDP 98-73, and the parcel map a adjustment which consolidates the two western parcels, and is subject to all c contained in the Mitigated Negative Declaration and the Mitigation Monita Reporting Program and Planning Commission Resolutions No. 4617,4618,46 4622, and 4623, and the City Engineer’s approval of the parcel map 01 adjustment. NOTICE Please take NOTICE that approval of your project includes the “imposition” dedications, reservations, or other exactions hereafter collectively referred to for convc “fees/exactions.” You have 90 days from date of final approval to protest imposition of these fees/exal you protest them, you must follow the protest procedure set forth in Government Coc 66020(a), and file the protest and any other required information with the City Mz processing in accordance with Carlsbad Municipal Code Section 3.32.030.
