HomeMy WebLinkAbout2000-01-05; Planning Commission; Resolution 4701& 1 2 3 4 5 6 7 8 9 0 0 I ~ PLANNING COMMISSION RESOLUTION NO. 4701 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PROGRAM TO BRING THE DESIGNATIONS ON THE LOCAL COASTAL PROGRAM, GENERAL PLAN, AND ZONING MAP INTO CONFORMANCE ON PROPERTY LOCATED NORTH OF POINSETTIA LANE, WEST OF EL CAMINO REAL AND EAST OF FUTURE SKIMMER COURT IN LOCAL FACILIITES MANAGEMENT ZONE 2 1. CASE NAME: STEINER PROPERTY CASE NO: LCPA 99-05 10 WHEREAS, California State law requires that the Local Coastal Progra 11 General Plan, and Zoning designations for properties in the Coastal Zone be in conformance; a 12 WHEREAS, Western Pacific Housing-Carlsbad 1, LLC, A Delaware Limit 13 14 15 16 17 Liability Company, “Developer”, has filed a verified application for an amendment to the Loc Coastal Program designations regarding property owned by Joseph and Marian Steiner a1 Western Pacific Housing-El Camino, LLC, A Delaware Limited Liability Compar “Owners”, described as 18 19 20 21 22 23 Being a subdivision of Parcel 1 of Parcel Map 2244, as filed in the Office of the County Recorder of San Diego County on January 10, 1974 as File No. 74-007317 of official records together with Lot 74 and Portion of Lots 67 and 68 of City of Carlsbad Tract 97-15, according to map thereof No. 13839, all in the City of Carlsbad, County of San Diego, State of California. (“the Property”); and 24 25 26 27 28 WHEREAS, said verified application constitutes a request for a Local Coas Program Amendment as shown on Exhibit “X”, attached to Planning Commission Resoluti No. 4700, and made a part hereof, dated January 5, 2000, STEINER PROPERTY, LC1 99-05, as provided in Public Resources Code Section 30574 and Article 15 of Subchapter r 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Chapter 2, Division 5.5 of Title 14 of the California Code of Regulations of the Califon Coastal Commission Administrative Regulations; and WHEREAS, the Planning Commission did on the 5th day of January, 2000, hc a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, State Coastal Guidelines requires a six week public review period any amendment to the Local Coastal Program and no comments were received. WHEREAS, at said public hearing, upon hearing and considering all testimo and arguments, if any, of all persons desiring to be heard, said Commission considered all factc relating to the Local Coastal Program Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannj Commission of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissi based on the following findings, and subject to the following conditions: RECOMMENDS APPROVAL of STEINER PROPERTY, LCPA 99- Findinm: 1. That the proposed Local Coastal Program Amendment meets the requirements of, and in conformity with, the policies of Chapter 3 of the Coastal Act and all applicable polic of the Mello I1 segment of the Carlsbad Local Coastal Program not being amended this amendment, in that the project is consistent with applicable policies requiring 1 undeveloped slopes to be placed in open space easements as a condition of appro’ and that the project will provide drainage and erosion control measures. 2. That the proposed amendment to the Mello I1 segment of the Carlsbad Local Coas Program is required to bring the designation of the City’s General Plan Land I Map, Zoning Map (as amended), and Mello I1 Implementation (the zoning m: into conformance. . .. ... ...
