A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO ALL SEGMENTS OF
THE CmSBAD LOCAL COASTAL PROGRAM TO MODIFY
THE CITYWIDE BASEMENT DEFINITION IN THE ZONING
ORDINANCE

WHEREAS, California State law requires that the Local Coastal Progr,
General Plan, and Zoning regulations for properties in the Coastal Zone be in conformance; ar
WHEREAS, the Zoning Ordinance is the implementing ordinance for the Ci
Local Coastal Program; and
WHEREAS, a verified application request for a Local Coastal Progl
Amendment as shown on Exhibit “X” dated January 5, 2000 as attached to Plann
Commission Resolution No. 4706 and incorporated herein by reference, as provided
Public Resources Code Section 30574 and Article 15 of Subchapter 8, Chapter 2, Division 5.1
Title 14 of the California Code of Regulations of the California Coastal Commis5
Administrative Regulations; and
WHEREAS, the Planning Commission did on the 5th day of January 2000,l
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testim
and arguments, if any, of all persons desiring to be heard, said Commission considered all fac
relating to the Local Coastal Program Amendment.
WHEREAS, State Coastal Guidelines requires a six week public review perioc
any amendment to the Local Coastal Program.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plm

A) That the foregoing recitations are true and correct.
B) At the end of the State mandated six week review period, starting on Decembel
1999, and ending on January 14, 2000, staff shall present to the City Counc
summary of the comments received.
C) That based on the evidence presented at the public hearing, the Commiss
RECOMMENDS APPROVAL of BASEMENT DEFINITION REVISI(
LCPA 99-07 based on the following findings, and subject to the follow
conditions:
Findings
1. That the proposed Local Coastal Program Amendment meets the requirements of, ani
in conformity with, the policies of Chapter 3 of the Coastal Act and all applicable polic
of all segments of the Carlsbad Local Coastal Program not being amended by
amendment, in that a more restrictive definition for “basements” citywide will
impact any coastal or shoreline resources, access provisions or recreation policie!
the coastal zone.
2. That the proposed amendment to all six segments of the Carlsbad Local Coastal Progl
is required to bring it into consistency with the City’s Zoning Ordinance.
