HomeMy WebLinkAbout2000-01-19; Planning Commission; Resolution 47100 0 1 2” 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 4710 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PROGRAM TO MAKE IT CONSISTENT WITH THE REPEAL AND REENACTMENT OF ZONING ORDINANCE CHAPTER 21.85 REGARDING AFFORDABLE HOUSING UNITS FOR LOWER-INCOME HOUSEHOLDS AND IN-LIEU FEES. CASE NAME: INCLUSIONARY HOUSING ORDINANCE CASE NO: LCPA 96-10 AMENDMENT WHEREAS, the City is repealing and reenacting Chapter 21.85 of Title (Zoning Ordinance) of the Carlsbad Municipal Code regarding affordable housing UI for lower-income households; and WHEREAS, the Zoning Ordinance is the implementing ordinance for the Cii Local Coastal Program; and WHEREAS, California State law requires that the Local Coastal Program Zoning Ordinance be in conformance and therefore amendments to the implementing ordina also require an amendment to the Local Coastal Program to ensure consistency between the 1 documents; and WHEREAS, a verified application for an amendment to the Local Coa Program has been filed with the Planning Department; and WHEREAS, said verified application constitutes a request for a Local Coa Program Amendment as shown on Exhibits “X” dated January 19, 2000, attached to Plann Commission Resolution No. 4709 and incorporated herein by reference as provided in Pu Resources Code Section 30574 and Article 15 of Subchapter 8, Chapter 2, Division 5.5 of 7 14 of the California Code of Regulations of the California Coastal Commission Administra Regulations; and 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 WHEREAS, the Housing Commission did on the 12th day of August, 195 hold a public meeting to consider a recommendation to the Planning Commission and Cj Council to amend Title 21 of the Carlsbad Municipal Code by the repeal and reenactme of Chapter 21.85 regarding affordable housing units for lower-income households and i lieu fees; and WHEREAS, at said public meeting, upon hearing and considering all testimon if any, of all persons desiring to be heard, said Commission considered all factors relating . the repeal and reenactment of Chapter 21.85, and voted to recommend approval of sa modifications; and WHEREAS, the Planning Commission did on the 19th day of January 20( hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimc and arguments, if any, of all persons desiring to be heard, said Commission considered all fact( relating to the Local Coastal Program Amendment; and WHEREAS, State Coastal Guidelines requires a six week public review period any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plann Commission of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting on Decem1 23, 1999 and ending on February 3,2000, staff shall present to the City COUI a summary of the comments received. 25 C) That based on the evidence presented at the public hearing, the Commiss 26 RECOMMENDS APPROVAL of INCLUSIONARY HOUSII ORDINANCE AMENDMENT, LCPA 99-06, based on the following finding 27 FindinFs: 28 1. That the proposed Local Coastal Program Amendment meets the requirements of, an( in conformity with, the policies of Chapter 3 of the Coastal Act and all applicable polic PC RES0 NO. 4710 -2- 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 * m of the Mello I, Mello 11, Agua Hedionda, Redevelopment, East Batiquitos, and W Batiquitos segments of the Carlsbad Local Coastal Program in that the propo! amendment is limited in nature in that it will not alter any coastal zone regulatio land use designations or policies, with which future projects subject to 1 inclusionary housing ordinance must comply. 2. That the proposed amendment to the segments of the Carlsbad Local Coastal Progran required to bring them into consistency with the proposed zone code amendment.
