A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE
RESIDENTIAL PROJECT ON PROPERTY GENERALLY
LOCATED ON THE SOUTH SIDE OF CHINQUAPIN AVENUE
BETWEEN GARFIELD STREET AND THE AT&SF RAILROAD
IN LOCAL FACILITIES MANAGEMENT ZONE 1.

WHEREAS, Merit Group, Inc., “Developer”, has filed a verified applicati
with the City of Carlsbad regarding properties owned by H. David Buckmaster and Patricia
Buckmaster (tenants in common) and by Carlsbad Beach Group Investors LLC, “Owner
described as
DEVELOPMENT PLAN SDP 99-02 TO DEVELOP AN 11-UNIT
The southwesterly 63 feet of Lot 6 and all of Lot 7, Block T, of
Palisades Unit No. 2, in the City of Carlsbad, County of San
Diego, State of California, according to Map 1803, filed August
25,1924
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Site Developmi
Plan as shown on Exhibits “A” - “R” dated March 15,2000, on file in the Planning Departme
CARLSBAD BEACH ESTATES - SDP 99-02 as provided by Chapter 21.06ISect:
21.53.120 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 15th day of March, 2000, hl

1 a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimc
l and arguments, if any, of all persons desiring to be heard, said Commission considered all fact
relating to the Site Development Plan.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plann
Commission of the City of Carlsbad as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Plannin
Commission APPROVES CARLSBAD BEACH ESTATES - SDP 994
based on the following findings and subject to the following conditions:
Findinm:
1. That the requested use is properly related to the site, surroundings and environmen
settings, is consistent with the various elements and objectives of the General Plan, M
not be detrimental to existing uses or to uses specifically permitted in the area in whj
the proposed use is to be located, and will not adversely impact the site, surroundings
traffic circulation, in that the proposed project is consistent with the resident
General Plan designations and zoning on the site, is compatible in scale and ty
with the surrounding setting, will not result in significant unmitigal
environmental impacts, and will not, therefore, adversely impact the site
surroundings.
2. That the site for the intended use is adequate in size and shape to accommodate the use,
that the site can accommodate the proposed structures while providing adequ:
setbackdyards, driveways, private and common recreation areas, and compatibil
of scale with neighboring developments.
3. That all yards, setbacks, walls, fences, landscaping, and other features necessary to adj
the requested use to existing or permitted future uses in the neighborhood will
provided and maintained, in that the project provides all required yards, includi
private yards and a common recreation area, privacy walls, and landscaping in 1
setbacks and around parking areas, and no other features are necessary
accommodate the use to the neighborhood.
4. That the street systems serving the proposed use is adequate to properly handle all tral
generated by the proposed use, in that the adjacent Chinquapin Avenue is a local str
which can accommodate the 88 new average daily trips which will be generated
the development.
Conditions:
1. This approval is granted subject to the approval of CT 99-01, PUD 99-01/CP 00-01, a
CDP 99-02 and is subject to all conditions contained in Planning Commiss:
Resolutions No. 4727 (Neg Dec), 4728,4730, and 4731 for those other approvals.
Code Reminders:
1. This Site Development Plan will expire twenty-four (24) months from the date
final approval.
