PLANNING COMMISSION RESOLUTION NO. 4770
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA7 DETERMINING THAT
IMPROVEMENTS PROGRAM BUDGET IS CONSISTENT
WITH THE GENERAL, PLAN.
THE PROPOSED FISCAL YEAR 2000-2001 CAPITAL
CASENAME: FISCAL YEAR 2000-2001 CAPITAL
IMPROVEMENTS BUDGET PROGRAM
CASE NO: PCD/GPC 00-01
WHEREAS, the City of Carlsbad, “City,” has filed a verified applicati
regarding various capital and public works projects, described as the proposed Fiscal Ye
2000-2001 Capital Improvements Program Budget (“CIP”); and
WHEREAS, said verified application constitutes a request for a Planni.
Commission Determination of General Plan Consistency of the CIP (PCD/GPC 00-01)
provided by Sections 65401 and 65402 of the California Government Code; and
WHEREAS, the Planning Commission did on the 17th day of May, 20C
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony a:
arguments, if any, of all persons desiring to be heard, said Commission considered all facto
relating to the Planning Commission Determination; and
WHEREAS, an analysis of the potential environmental impacts of adoption
the CIP was conducted as required by the California Environmental Quality Act (CEQA
and
I WHEREAS, those proposed capital and public works activities listed und ’ Category I of Exhibit C have been determined to not meet the definition of a “project” pc
CEQA or are exempt under specified provisions of CEQA; and
WHEREAS, those proposed capital and public works projects listed under

Category I1 of Exhibit C have either already undergone adequate environmental review (
are currently undergoing CEQA analysis and preparation of documents separate from th
action to adopt the CIP; and
WHEREAS, those proposed capital and public works projects listed und
Category I11 of Exhibit C have been found to lack sufficient information to make
determination of potential environmental impacts at this time and therefore are beil
approved and funded only for purposes of preliminary design and environmental analysi!
and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, the Commission here
DETERMINES that the proposed CIP budget Project is consistent with t
General Plan and APPROVES PCD/GPC 00-01, based on the followi
findings and subject to the following conditions:
Findings:
1. The project is consistent with the goals, objectives, and implementing policies oft
City’s General Plan in that the project ensures and requires the provision
adequate public facilities and services concurrent with or prior to need.
2. The project is consistent with the Land Use, Circulation, Public Safety, and Par
and Recreation Elements of the General Plan in that the project implements the g(
of the Land Use Element which requires that public facilities be adequate to sel
the projected population of the City.
3. As provided for in the General Plan, the proposed improvements are consistent w
the City’s Growth Management Plan in that the project ensures that the necess2
improvements are provided for streets, traffic signals, sewer facilities, wa
facilities, drainage facilities, and civic projects in accordance with the performa1
standards contained in the City’s Growth Management regulations.
4. The projects listed under Category I of Exhibit “C” have been found by 1
Planning Director to not be projects, or be exempt projects within the meaning
CEQA, and the Director will file an appropriate Notice of Determination upon fi1
decisionmaker approval of those projects as part of the 2000-2001 Fiscal Year C
Budget.

5. The projects listed under Category I1 have been found by the Planning Director
either have already undergone adequate environmental review or curreni
undergoing separate CEQA review, and the final decisionmaker will not make
commitment to such projects by mere approval of the CIP budget, witha
completion of that separate CEQA documentation.
6. The projects listed under Category I11 have been determined by the Planni
Director to be only requesting and being considered for budget approval of studi
information gathering, and/or environmental studies, all of which are exempt unc
CEQA Guidelines Section 15262, and the Director will file a Notice of Determinati!
upon final decisionmaker approval of those projects as part of the 2000-2001 Fisc
Year CIP Budget.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planni
Commission of the City of Carlsbad, California, held on the 17th day of May, 2000, by t
following vote, to wit:

L’Heweux, Nielsen, Segall, and Trigas
