HomeMy WebLinkAbout2000-06-07; Planning Commission; Resolution 4775c I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 P PLANNING COMMISSION RESOLUTION NO. 4775 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE DEVELOPMENT PERMIT TO DEVELOP AN 18 HOLE CHAMPIONSHIP GOLF COURSE WITH CLUBHOUSE AND PRACTICE FACILITIES ON PROPERTY GENERALLY LOCATED NORTH OF PALOMAR AIRPORT ROAD AND EAST AND WEST OF COLLEGE BOULEVARD IN LOCAL FACILITIES MANAGEMENT ZONES 5 AND 8 CASE NAME: CARLSBAD MUNICIPAL GOLF COURSE CASE NO: HDP 97-08 WHEREAS, The City of Carlsbad, “Developer and Owner”, has filed a verified application regarding property described as Approximately 397 acres north of Palomar Airport Road and west of Palomar Airport including Assessor’s Parcel Numbers 212-041~[12-371; 212-Ogl-[2-211; 212-082~[l-lo]; 212-201- [5,7,11,12,13] (“the Property”); and WHEREAS, said verified application constitutes a request for a Hillside Development Permit as shown on Exhibit(s) “A” - “H” dated June 7, 2000, on file in the Carlsbad Planning Department CARLSBAD MUNICIPAL GOLF COURSE, HDP 97-08, as provided by Chapter 21.95 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 1st day of April 1998, and on the 7th day of June, 2000 consider said request; and WHEREAS, elements of the project approved on April 1, 1998 have been changed and or deleted and the final project design is shown on Exhibits “A” - “H” dated June 7,200O; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Hillside Development Permit. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning I Commission as follows: A) B) That the foregoing recitations are true and correct. That based on the evidence presented at the public hearing, the Commission APPROVES CARLSBAD MUNICIPAL GOLF COURSE, HDP 97-08 based on the following findings and subject to the following conditions: FindinPs: 1. That hillside conditions have been properly identified on the constraints map which show existing and proposed conditions and slope percentages; 2. That undevelopable areas of the project, i.e. slopes over 40%, have been properly identified on the constraints map; 3. That as conditioned the development proposal is consistent with the intent, purpose, and requirements of the Hillside Ordinance, Chapter 21.95, in that hillside alteration will not result in substantial damage or alteration of significant natural resource areas, wildlife habitats or native vegetation areas; the natural appearance of hillsides is preserved by assuring that development density and intensity relates to the slope of the land, and is compatible with hillside preservation; proper design is utilized in grading, landscaping and in the development of structures and roadways to preserve the natural appearance of hillsides; a healthful and aesthetically pleasing environment is preserved and enhanced by assuring that hillside development is pleasing to the eye, rich in variety, highly identifiable, and reflects the City’s cultural and environmental values; hillside conditions are properly identified and incorporated into the planning process; the intent of the land use and open space/conservation elements of the Carlsbad General Plan are implemented; erosion is prevented and the lagoons protected from excessive siltation; 4. That the development of structures will not occur in the undevelopable portions of the site pursuant to provisions of Section 21.53.230 of the Carlsbad Municipal Code, in that all structures are located within areas that have been identified as developable. 5. That as conditioned the project design substantially conforms to the intent of the concepts illustrated in the Hillside Development Guidelines Manual, in that all manufactured slopes will be contoured and undulate to best reflect natural hillside conditions. 6. That the project design and lot configuration minimizes disturbance of hillside lands, in that the project has been designed to take advantage of existing areas of less slope gradient. Staff is authorized and directed to make, or require Developer to make, all corrections and modifications to the Hillside Development Permit document(s) necessary to make them internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Any proposed development different from this approval, shall require an amendment to this approval. All manufactured slopes shall be contoured and undulate to best reflect natural hillside conditions. All of the Exhibits dated April 1, 1998 shall be superseded by project exhibits dated June 7,200O. Planning Commission Resolution No. 4254 shall be superseded by this Planning Commission Resolution No. 4775. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 7th day of June 2000, by the following vote, to wit: AYES: Chairperson Compas, Commissioners Baker, Heineman, L’Heureux, Nielsen, Segall, and Trigas NOES: ABSENT: ABSTAIN: WILLIAM COMPAS, Chairperson CARLSBAD PLANNING COMMISSION ATTEST: Planning Director PC RESO NO. 4775 -3-
