HomeMy WebLinkAbout2000-08-02; Planning Commission; Resolution 48261 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 4826 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL PLAN CONSISTENCY FOR THE ACQUISITION OF PROPERTY ADJACENT TO THE EXISTING CITY-OWNED PROPERTY LOCATED AT 2075 LAS PALMAS DRIVE. CASE NAME: LAS PALMAS DRIVE PROPERTY ACQUISITION CASE NO: PCD/GPC 00-03 WHEREAS, the City of Carlsbad, “Developer,” has filed a verified application regarding property owned by the Hawthorne Family Trust, “Owner,” described as Lot 4 of Carlsbad Tract No. SO-33 According to Map No. 10061 Filed April 15, 1981 in the Office of the County Recorder, County of San Diego. (“the Property”); and WHEREAS, said verified application constitutes a request for a Planning Commission Determination for General Plan Consistency, on file in the Planning Department LAS PALMAS DRIVE PROPERTY ACQUISITION - PCDlGPC 00-03, as provided in Carlsbad Municipal Code Section 2.24.065 and Section 65402 of the California Government Code; and WHEREAS, the Planning Commission did on the 2nd day of August, 2000, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination of General Plan Consistency; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission hereby DETERMINES that the LAS PALMAS DRIVE PROPERTY ACQUISITION 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 is consistent with the General Plan and APPROVES PCD/GPC 00-03, based on the following: Finding: 1. This project is consistent with the goals, objectives, policies, and implementation programs of the City’s General Plan in that the proposed acquisition of the property (with the subsequent consolidation of the property with the 2075 Las Palmas Drive property) will provide the 2075 Las Palmas Drive property with an adequate amount of on-site parking needed to accommodate those uses prescribed by the General Plan land use designation for the site. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 2nd day of August, 2000, by the following vote, to wit: AYES: NOES: Chairperson Compas, Commissioners Heineman, L’Heureux, Segall, and Trigas ABSENT: Commissioners Baker and Nielsen ABSTAIN: lLth2?CWti WILLIAM COMPAS, Chair&rson CARLSBAD PLANNING COMMISSION ATTEST: MICHAEL J.
