PLANNING COMMISSION RESOLUTION NO. 4823
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING A PLAN-
NING COMMISSION DETERMINATION ON PROPERTY
GENERALLY LOCATED EAST OF EL FUERTE AND NORTH
OR RANCH0 PANCHO IN LOCAL FACILITIES MANAGE-
MENT ZONE 11.
CASE NAME: RANCH0 CARRILLO VILLAGE T
CASE NO: PCD 00-02
WHEREAS, Continental Residential, Inc., “Developer,” and “Owner,” has tiled
a verified application with the City of Carlsbad regarding property described as
Lot 103 or Carlsbad Tract No. 93-04, Ranch0 Carrillo Village
“Q”? in the City of Carlsbad, County of San Diego, State of
California, according to map thereof No. 13551, filed in the
Office of the County Recorder of San Diego County, March 31,
1998
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination, on tile in the Planning Department, RANCH0 CARRILLO
VILLAGE T - PCD 00-02, as provided by Chapter VIII.C.20 of the Ranch0 Carrillo Master
Plan (MP 139F); and
WHEREAS, the Planning Commission did notice a public hearing on the 16th
day of August, 2000, which was continued to the 6th day of September, 2000, and was
further continued to the 20th day of September, 2000 to consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.

9 That based on the evidence presented at the hearing, the Commission DENIES the
reversion of Ranch0 Carrillo Village T from a community service facility to
the underlying Residential-Medium land use designation based on the
following findings and subject to the following conditions:
Findings:
1. That Village T of the Ranch0 Carrillo Master Plan has not been utilized as a
community service facility within three years of the grading of the right-of-way for
El Fuerte or Ranch0 Pancho.
2. That the applicant failed to provide information to sufficiently show that a good
faith effort has been made to market the site to a community facility type use during
the three year period.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 20th day of September, 2000, by
the following vote, to wit:
AYES: Chairperson Compas, Commissioners Baker, Heineman,
L’Heureux, Nielsen, Segall, and Trigas
