A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A SPECIAL USE PERMIT AMENDMENT TO
ALLOW THE INSTALLATION OF WALL-MOUNTED SIGNS
ON BUILDINGS GENERALLY LOCATED IN 6100-6200
BLOCK OF EL CAMINO REAL IN LOCAL FACILITIES
MANAGEMENT ZONE 5

WHEREAS, Signs and Services, “Developer”, has filed a verified application
with the City of Carlsbad regarding property owned by LNP Real Estate Limited Partnership,
“Owner”, described as
All that portion of lot “F” of Ran&o Agua Hedionda, in the
City of Carlsbad, County of San Diego, State of California,
according to map thereof No. 823, filed in the office of the
county recorder of San Diego County, November 16,1896; and
Parcels 1 through 4 inclusive, of Parcel Map 8403, in the City
of Carlsbad, County of San Diego, State of California,
according to map thereof filed in the office of the County
Recorder of San Diego County, February 8,1979.
(‘the Property”); and
WHEREAS, said verified application constitutes a request for a Special Use
Permit Amendment as shown on Exhibits “A” - “C” dated September 20, 2000, on tile in the
Planning Department VIASAT SIGNS - SUP 98-03(A), as provided by the conditions of
approval of SUP 98-03 and by Chapter 21.40/21.110 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 20th day of September, 2000,
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Special Use Permit Amendment;

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission
APPROVES VIASAT SIGNS - SUP 98-03(A), including the provision for
wall-mounted signs facing El Camino Real, on Buildings 1, 4 and 6 of the
Lincoln North Pointe project, based on the following findings and subject to the
following conditions:

Compliance with the wall sign restriction identified in the El Camino Real Scenic
Preservation development standards is infeasible for the Legacy North Pointe
project in that name recognition provided via wall sign is essential to the business
success of Legacy North Pointe tenants.
The scenic qualities of the corridor will continue to be maintained if the standard is
not maintained in that the wall signs exhibit a high degree of design quality (i.e.
materials, color, and method of illumination) and are consistent with other signs on
the site, which will minimize the potential for negative visual impacts.
The project will not have an adverse impact on traffic safety in that wall signage will
provide clear tenant visibility from the street and parking area, therefore enhancing
traffic circulation and safety.
The project is designed so as to meet the intent of the scenic preservation overlay
zone in that the wall signs exhibit a high design quality (i.e. materials, color, and
method of illumination) and are consistent with other signs on the site, which will
minimize the potential for negative visual impacts.
Conditions:
1. Staff is authorized and directed to make, or require Developer to make, all corrections
and modifications to the Special Use Permit document(s) necessary to make them
internally consistent and in conformity with final action on the project. Development
shall occur substantially as shown in the approved Exhibits, which indicate the
installation of one (1) thirty-five (35) square foot sign on Building 1, one (1) thirty-
five (35) square foot sign on Building 4, and one (1) sign on Building 6. The sign for
the unidentified, Building 6 tenants/tenants shall not exceed fifty (50) square feet in
area. All sign letters shall not exceed a height of thirty-six (36) inches. All sign shall
be back, or “halo” lit. Any proposed development different from this approval, shall
require an amendment to this approval.
2. All signs shall comply with the approved sign program for the site and are required
to obtain individual sign permits prior to installation.

NOTICE
Please take NOTICE that approval of your project includes the “imposition” of fees,
dedications, reservations, or other exactions hereafter collectively referred to for convenience as
“fees/exactions.”
You have 90 days from date of final approval to protest imposition of these fees/exactions. If
you protest them, you must follow the protest procedure set forth in Government Code Section
66020(a), and file the protest and any other required information with the City Manager for
processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely
follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or
annul their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions
DOES NOT APPLY to water and sewer connection fees and capacity charges, nor planning,
zoning, grading or other similar application processing or service fees in connection with this
project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given
a NOTICE similar to this, or as to which the statute of limitations has previously otherwise
expired.
PASSED, APPROVED AND ADOPTED at a regular meeting of the planning
Commission of the City of Carlsbad, California, held on the 20th day of September, 2000, by
the following vote, to wit:
