PLANNING COMMISSION RESOLUTION NO. 4881
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION OF GENERAL
PLAN CONSISTENCY FOR THE CITY ACQUISITION OF
PROPERTIES LOCATED AT 3354 & 3366 MADISON STREET.

CASE NO: PCD/GPC 00-04
WHEREAS, the City of Carlsbad, “Developer”, has tiled a verified application
regarding property owned by the John H. and Violet M. Diab Family Trust, “Owner”,
described as
The 14,000 square foot lot (2 7,000 square foot lots combined)
located on the easterly side of Madison Street 100 feet north of
the Madison Street/Chestnut Avenue intersection in the City of
Carlsbad, County of San Diego.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination for General Plan Consistency, on file in the Planning Department
3354 & 3366 MADISON STREET PROPERTY ACQUISITION PCD/GPC 00-04, as
provided in Carlsbad Municipal Code Section 2.24.065 and Section 65402 of the California
Government Code; and
WHEREAS, the Planning Commission did on the 15th day of November 2000
consider said request and continued the matter to the 6th day of December 2000; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination of General Plan Consistency; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
1 B) That based on the evidence presented at the hearing, the Commission hereby
DETERMINES that the 3354 & 3366 Madison Street Property Acquisition is 2 consistent with the General Plan and APPROVES PCD/GPC 00-04, based on
3 the following:
Finding:
4 1. This project is consistent with the goals, objectives, policies, and implementation
5 programs of the City’s General Plan in that the property proposed to be acquired is
designated for residential uses which would allow public facilities subject to the
6 conditional use permitting procedure.
2. That the Planning Director has determined that the project belongs to a class of
projects that the State Secretary for Resources has found do not have a significant
impact on the environment, and it is categorically exempt from the requirement for
the preparation of environmental documents pursuant to 15061(b)(3) of the State
CEQA Guidelines.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 6th day of December 2000, by the
following vote, to wit:
