PLANNING COMMISSION RESOLUTION NO. 4882
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION OF GENERAL
PLAN CONSISTENCY FOR THE CITY ACQUISITION OF
PROPERTIES LOCATED AT 2923 ELMWOOD STREET.

CASE NO: PCDiGPC 00-05
WHEREAS, the City of Carlsbad, “Developer”, has filed a verified application
regarding property owned by the James W. Carey Estate, “Owner”, described as
The 11,700O square foot lot located on the east side of Elmwood
Street 200 feet north of the Elmwood StreeULaguna Drive
intersection in the City of Carlsbad, County of San Diego.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination for General Plan Consistency, on file in the Planning Department
2923 ELMWOOD STREET PROPERTY ACQUISITION PCD/GPC 00-05, as provided in
Carlsbad Municipal Code Section 2.24.065 and Section 65402 of the California Government
Code: and
WHEREAS, the Planning Commission did on the 15th day of November 2000
and on the 6th day of December 2000, consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination of General Plan Consistency; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, the Commission hereby
DETERMINES that the 2923 Elmwood Street Property Acquisition is
1 consistent with the General Plan and APPROVES PCD/GPC 00-05, based on
the following: 2 Findinp:
3 1. This project is consistent with the goals, objectives, policies, and implementation
4 programs of the City’s General Plan in that the property proposed to be acquired is
designated for residential uses which would allow public facilities subject to the
5 conditional use permitting procedure.
6 2. That the Planning Director has determined that the project belongs to a class of
projects that the State Secretary for Resources has found do not have a significant 7 impact on the environment, and it is categorically exempt from the requirement for
8 the preparation of environmental documents pursuant to 15061(b)(3) of the State
CEQA Guidelines.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning

Commission of the City of Carlsbad, California, held on the 6th day of December 2000, by the
following vote, to wit:

L’Heureux, Nielsen, Segall, and Trigas
