PLANNING COMMISSION RESOLUTION NO. 4905
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION OF GENERAL
PLAN CONSISTENCY FOR THE CITY ACQUISITION OF
PROPERTIES LOCATED AT 1635 FARADAY AVENUE.
CASE NAME: FARADAY BUILDING PURCHASE
CASE NO: PCD/GPC 00-06
WHEREAS, the City of Carlsbad, “Developer,” has filed a verified application
regarding property owned by Faraday Business Plaza, L.L.C, “Owner,” described as
Lot 106 of the Carlsbad Research Center Unit No. 5 in the City
of Carlsbad, County of San Diego, State of California,
according to the map thereof No. 12815, filed in the office of
the County Recorder of San Diego.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination for General Plan Consistency, on tile in the Planning Department
FARADAY BUILDING PURCHASE - PCDlGPC 00-06, as provided in Carlsbad Municipal
Code Section 2.24.065 and Section 65402 of the California Government Code; and
WHEREAS, the Planning Commission did on the 3rd day of January 2001; hold
a duly noticed public hearing as prescribed by law to consider said request: and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination of General Plan Consistency; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
-4 That the foregoing recitations are true and correct,
B) That based on the evidence presented at the hearing, the Commission hereby
DETERMINES that the project is consistent with the General Plan and
APPROVES FARADAY BUILDING PURCHASE - PCD/GPC 00-06, based
on the following:

1. This project is consistent with the goals, objectives, policies, and implementation
programs of the City’s General Plan in that the property proposed to be acquired is
designated for industrial and office uses which allow public or civic uses.
2. That the Planning Director has determined that the project belongs to a class of
projects that the State Secretary for Resources has found do not have a significant
impact on the environment, and it is categorically exempt from the requirement for
the preparation of environmental documents pursuant to 15061(b)(3) of the State
CEQA Guidelines.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 3rd day of January 2001, by the
following vote, to wit:
AYES: Chairperson Segall, Commissioners Baker, Compaq Heineman,
L’Heureux, Nielsen, and Trigas
