HomeMy WebLinkAbout2001-05-02; Planning Commission; Resolution 49711 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 4971 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE PROPOSED FISCAL YEAR 2001-2002 CAPITAL IMPROVEMENTS PROGRAM BUDGET FOR NEW PROJECTS IS CONSISTENT WITH THE GENERAL PLAN. CASE NAME: FISCAL YEAR 2001-2002 CAPITAL IMPROVEMENTS BUDGET PROGRAM CASE NO: PCD/GPC 01-01 WHEREAS, the City of Carlsbad, “City”, has filed a verified application regarding various capital and public works projects, described as the proposed Fiscal Year 2001-2002 Capital Improvements Program Budget (“CIP”); and WHEREAS, said verified application constitutes a request for a Planning Commission Determination of General Plan Consistency of the CIP (PCDIGPC 01-01) as provided by Sections 65401 and 65402 of the California Government Code; and WHEREAS, the Planning Commission did on the 2nd day of May 2001, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination; and WHEREAS, an analysis of the potential environmental impacts of each of the capital and public works projects included for adoption in the CIP was conducted as required by the California Environmental Quality Act (CEQA); and WHEREAS, those proposed, new capital and public works activities listed under Category I of Exhibit C have been determined to not meet the definition of a “project” per CEQA or are exempt under specified provisions of CEQA; and WHEREAS, as to those proposed capital and public works projects listed under Category II of Exhibit C there has been found to be a lack of sufficient information 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 to make a determination of potential environmental impacts at this time and they are therefore being approved and funded only for purposes of preliminary design and further environmental analysis; NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) W That the foregoing recitations are tree and correct. That based on the evidence presented at the hearing, the Commission hereby DETERMINES that the proposed CIP budget Project is consistent with the General Plan and APPROVES FISCAL YEAR 2001-2002 CAPITAL IMPROVEMENTS BUDGET PROGRAM - PCD/GPC 01-01, based on the following findings and subject to the following conditions: Findines: 1. 2. 3. 4. 5. The project is consistent with the goals, objectives, and implementing policies of the City’s General Plan in that the project ensures and requires the provision of adequate public facilities and services concurrent with or prior to need. The project is consistent with the Laud Use, Circulation, Public Safety, and Parks and Recreation Elements of the General Plan in that the project implements the goal of the Land Use Element which requires that public facilities be adequate to serve the projected population of the City. As provided for in the General Plan, the proposed improvements are consistent with the City’s Growth Management Plan in that the project ensures that the necessary improvements are provided for streets, traffic signals, sewer facilities, water facilities, drainage facilities, and civic projects in accordance with the performance standards contained in the City’s Growth Management regulations. The projects listed under Category I of Exhibit “C” have been found by the Planning Director to not be projects, or be exempt projects within the meaning of CEQA, and the Director will file an appropriate Notice of Determination upon final decision maker approval of those projects as part of the 2001-2002 Fiscal Year CIP Budget. The projects listed under Category II have been determined by the Planning Director to be only requesting and being considered for budget approval of studies, information gathering, and/or environmental studies, all of which are exempt under CEQA Guidelines Section 15262, and the Director will file a Notice of Determination upon final decisionmaker approval of those projects as part of the 2001-2002 Fiscal Year CIP Budget.
