HomeMy WebLinkAbout2002-01-16; Planning Commission; Resolution 51451 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 5145 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALJFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL PLAN CONSISTENCY FOR THE CITY ACQUISITION OF PROPERTIES LOCATED AT 3340 MADISON STREET. CASENAME: 3340 MADISON STREET PROPERTY ACQUISITION CASE NO: PCD/GPC 02-01 WHEREAS, the City of Carlsbad, “Developer”, has filed a verified application regarding property owned by Russell L. Bennett, “Owner”, described as APN 204-093-03, Blk 45 Lots 9 & 10, located on the easterly side of Madison Street mid-block between Walnut Avenue and Chestnut Avenue in the City of Carlsbad, County of San Diego. (“the Property”); and WHEREAS, said verified application constitutes a request for a Planning Commission Determination for General Plan Consistency, on file in the Planning Department 3340 MADISON STREET PROPERTY ACQUISITION - PCD/GPC 02-01, as provided in Carlsbad Municipal Code Section 2.24.065 and Section 65402 of the California Government Code; and WHEREAS, the Planning Commission did on the 16th day of January 2002 consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination of General Plan Consistency; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission hereby DETERMINES that the 3340 MADISON STREET PROPERTY 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ACQUISITION is consistent with the General Plan and APPROVES PCD/GPC 02-01, based on the following: Finding: 1. This project is consistent with the goals, objectives, policies, and implementation programs of the City’s General Plan in that the property proposed to be acquired is designated for residential uses which would allow public facilities subject to the conditional use permitting procedure. 2. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is categorically exempt from the requirement for the preparation of environmental documents pursuant to 15061(b)(3) of the State CEQA Guidelines. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 16th day of January 2002, by the following vote, to wit: AYES: Chairperson Trigas, Commissioners Baker, Compas, Dominguez, Heineman, Nielsen, and Segall NOES: ABSENT: ABSTAIN: - SEENA TRIGAS, Chairpersa CARLSBAD PLANNING COMMISSION ATTEST: MICHAEL J. mZMffLER Planning Director PC RES0 NO. 5145 -2-
