PLANNING COMMISSION RESOLUTION NO. 5189
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT
BUDGET IS CONSISTENT WITH THE GENERAL PLAN.
PROGRAM BUDGET
THE FY 2002-2003 CAPITAL IMPROVEMENT PROGRAM
CASE NAME: FY 2002-2003 CAPITAL IMPROVEMENT
CASE NO: PCD/GPC 02-02
WHEREAS, the City of Carlsbad, "Developer," has filed a verified application
with the City of Carlsbad regarding property owned by various owners, "Owner," described as
citywide
("the Property"); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination of General Plan Consistency pursuant to Sections 65401 and
65402 of the California Government Code; and
WHEREAS, the Planning Commission did on the 1st day of May 2002, consider
said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination of General Plan Consistency; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, the Commission
DETERMINES that FY 2002-2003 Capital Improvement Program Budget -
PCD/GPC 02-02 is consistent with the General Plan and APPROVES
PCD/GPC 02-02 based on the following findings:

The project is consistent with the goals, objectives, and policies of the City's General
Plan in that the project requires and ensures the provision of adequate public
facilities and services concurrent with or prior to need.
The project is consistent with the Land Use, Circulation, Public Safety, and Parks
and Recreation Elements of the General Plan in that the project implements the
Land Use Element goal requiring that public facilities be adequate to serve the
projected population of the City.
As required by the General Plan, the proposed improvements are consistent with
the City's Growth Management Plan in that the project ensures that the necessary
improvements are provided for public accessibility, parks, drainage, sewer, water
distribution, traffic signals, streets, and miscellaneous projects in accordance with
the performance standards contained in the City's Growth Management
regulations.
That the projects listed as "exempt" or "not a project" under Category I of Exhibit
"C" have been found by the Planning Director to be exempt or not a project within
the meaning of CEQA, and a Notice of Exemption will be filed by the Director upon
final approval of those projects as part of the FY 2002-2003 CIP Budget.
That the projects listed as "exempt" under Category I1 of Exhibit "C" have been
found by the Planning Director to be exempt pursuant to Section 15262 of CEQA,
and a Notice of Exemption will be filed by the Director upon final approval of those
projects as part of the FY 2002-2003 CIP Budget.
That the projects listed as "requiring CEQA review" under Category I11 of Exhibit
"C" will not be implemented until all required CEQA actions have been completed.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 1st day of May 2002, by the
following vote, to wit:
AYES: Chairperson Trigas, Commissioners Baker, Dominguez,
Heineman, Segall, White, and Whitton
