HomeMy WebLinkAbout2002-05-15; Planning Commission; Resolution 51431 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 5143 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A SITE DEVELOPMENT PLAN AMENDMENT ISSUANCE OF BUILDING PERMITS FOR 20 HOTEL UNITS AND 1,600 SQUARE FEET OF MEETING SPACE ON PROPERTY GENERALLY LOCATED AT 5805 ARMADA DRIVE IN LOCAL FACILITIES MANAGEMENT ZONE 13. CASE NAME: GRAND PACIFIC PALISADES RESORT CASE NO.: SDP 96-0 1 (B) WHEREAS, Grand Pacific Palisades, LLC “Developer/Owner,” has filed a SDP 96-01(B) TO EXTEND THE DEADLINE FOR THE verified application with the City of Carlsbad regarding property described as Lot 14 of Carlsbad Tract No. 92-07 in the City of Carlsbad, County of San Diego, State of California, according to ‘map thereof No. 13215, filed in the office of the County Recorder of San Diego County on June 30,1995. (“the Property”); and WHEREAS, said verified application constitutes a request for a Site Development Plan Amendment as shown on Exhibit “A” dated May 15, 2002, on file in the Planning Department, GRAND PACIFIC PALISADES RESORT - SDP 96-01(B) as provided by Chapter 21.06 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 15th day of May, 2002, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Site Development Plan Amendment. WHEREAS, on June 6, 2000, the City Council approved, SDP 96-01(A), as described and conditioned in City Council Resolution No. 2000-181. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Planning Commission RECOMMENDS APPROVAL of GRAND PACIFIC PALISADES RESORT - SDP 96-01(B) based on the following findings and subject to the following conditions: Findinm: 1. That all of the findings of Planning Commission Resolution No. 4732 apply and are incorporated by this reference. Conditions: 1. 2. 3. 4. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Grand Pacific Palisades Resort Site Development Plan documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development different fi-om this approval, shall require an amendment to this approval. All of the conditions of Planning Commission Resolution No. 4732 apply except as modified below and are incorporated by this reference. The following condition shall replace Condition No. 25 of Planning Commission Resolution No. 4732: This approval shall become null and void if building permits are not issued for this project by June 6, 2005 unless an extension is approved. The following condition shall be added to Planning Commission Resolution No 4732: Prior to the issuance of grading permit or building permit, whichever occurs first, the applicant shall submit for city approval a “Storm Water Pollution Prevention Plan (SWPPP). The SWPPP shall be in compliance with current requirements and provisions established by the San Diego Region of the California Regional Water Quality Control Board. The SWPPP shall address measures to reduce to the maximum extent possible storm water pollutant runoff at both construction and post-construction phases of the project. At a minimum, the Plan shall: A. IdentifL existing and post-development on-site pollutants; B. Recommend source control Best Management Practices (BMPs) to filter said C. Establish specific procedures for handling spills and routine clean up. Special consideration and effort shall be applied to employee and customer education on the proper procedures for handling clean up and disposal of pollutants. pollutants; D. If maintaining post-development rates at pre-development levels cannot be achieved, adequate justification subject to the City Engineer’s approval must be provided. NOTICE Please take NOTICE that approval of your project includes the “imposition” of fees, dedications, reservations, or other exactions hereafter collectively referred to for convenience as “fees/exactions.” You have 90 days from date of final approval to protest imposition of these feedexactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020(a), and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. You are hereby FURTHER NOTIFIED that your right to protest the specified feedexactions DOES NOT APPLY to water and sewer connection fees and capacity charges, nor planning, zoning, grading or other similar application processing or service fees in connection with this project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given a NOTICE similar to this, or as to which the statute of limitations has previously otherwise expired. ... ... ... ... ... ... ...
