CASE NAME: NEXTEL WIRELESS TELECOM FACILITY
CASE NO.: CUP 02-04
WHEREAS, Nextel of California, “Developer”, has filed a verified application
with the City of Carlsbad regarding property owned by Pinnacle Carlsbad, LLC, “Owner”,
described as
CONDITIONAL USE PERMIT CUP 02-04 TO ALLOW THE
Lot 9 and 10 of Carlsbad Tract No. 81-5 in the City of
Carlsbad, County of San Diego, State of California, according

(“the Property”); and

B) That based on the evidence presented at the public hearing, the Commission
APPROVES NEXTEL WIRELESS TELECOM FACILITY - CUP 02-04,
based on the following findings and subject to the following conditions:
Findings:
1.
2.
3.
4.
5.
6.
7.
That the requested use is necessary or desirable for the development of the community, is
essentially in harmony with the various elements and objectives of the General Plan, and
is not detrimental to existing uses specifically permitted in the zone in which the
proposed use is located, in that the proposed use benefits the community by providing
better and improved wireless access for Nextel customers and the site’s commercial
land use designation does not preclude the provision of quasi-public utility uses.
That the site for the intended use is adequate in size and shape to accommodate the use, in
that the project meets all City standards and policies without the need for a variance
from standards.
That all the yards, setbacks, walls, fences, landscaping, and other features necessary to
adjust the requested use to existing or permitted fbture uses in the neighborhood will be
provided and maintained, in that no adjustments are necessary to allow the proposal to
be located within the project boundaries. To minimize potential visual impacts
created by the project, the antennas will be installed within the parapet wall and
will not be visible from outside. The equipment enclosure is also designed as such
that it seems as an extension of the building and is painted to match the exterior of
the building.
That the street system serving the proposed use is adequate to properly handle all traffic
generated by the proposed use, in that the proposed use would not generate additional
vehicle trips beyond that necessary for regular maintenance.
The Planning Commission finds that the project, as conditioned herein, is in
conformance with the City’s General Plan, based on the facts set forth in the staff report
dated May 15,2002 and recognizing that telecommunications are an integral part of
the built environment defined by the General Plan and that telecommunications
facilities are necessary and essential for the provision of the service.
That the proposed wireless communication facility is consistent with Council Policy No.
64, in that the proposed installation of antennas within the parapet wall will not have
any adverse visual impacts and the design of equipment enclosure is such that it
seems as an extension of the subject building.
That the Planning Director has determined that the project belongs to a class of projects
that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15303 - new construction
or conversion of small structures of the state CEQA Guidelines. In making this
determination, the Planning Director has found that the exceptions listed in Section
15300.2 of the state CEQA Guidelines do not apply to this project.

8. The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed
to mitigate impacts caused by or reasonably related to the project, and the extent and the
degree of the exaction is in rough proportionality to the impact caused by the project.
