PLANNING COMMISSION RESOLUTION NO. 5248
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LOCAL
FACILITIES MANAGEMENT PLAN FOR ZONE 16 TO
UPDATE AND BE CONSISTENT WITH THE CARLSBAD
OAKS NORTH SPECIFIC PLAN NORTH OF PALOMAR
AIRPORT ROAD BETWEEN EL CAMINO REAL AND THE
CITY’S EASTERN BOUNDARY IN LOCAL FACILITIES
MANAGEMENT ZONE 16.

WHEREAS, Techbilt Construction Corp., “Developer,” has filed a verified
application with the City of Carlsbad regarding property owned by Carlsbad Oaks North
Partners, L.P.
WHEREAS, said application constitutes a request for a Local Facilities
Management Plan Amendment for Zone 16 dated August 21, 2002, on file in the Planning
Department) and incorporated by this reference (collectively referred to as the “Local Facilities
Management Plan Amendments”), as provided in Section 21.90.125 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 21st day of August 2002, hold
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Local Facilities Management Plan for Zone 16.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission
RECOMMENDS APPROVAL of an amendment for Local Facilities

Management Plan - Zone 16, based on the following findings and subject to the
following conditions:
Findinm:
1. That the Local Facilities Management Plan amendment for Zone 16 is consistent with
Chapter 21.90 of the Carlsbad Municipal Code (Growth Management), and with the
Citywide Facilities and Improvement Plan, in that special conditions for parks, drainage
facilities, circulation, schools, sewer collection system, and water collection system, to
ensure that public facilities meet demand in the zone are included. This ensures
implementation of and consistency with the General Plan and protects the public health,
safety and welfare by ensuring that public facilities and improvements will be installed to
serve new development prior to or concurrently with need.
Conditions:
1. Approval is granted for an amendment to Local Facilities Management Plan - Zone 16 as
contained in the Plan titled Local Facilities Management Plan Zone 16, dated August 21,
2002, incorporated herein by reference and on file in the Planning Department. The
amended Zone 16 Local Facilities Management Plan, dated August 21, 2002, shall
replace the specified sections of the Zone 16 LFMP dated February 19,1992.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, held on the 21st day of August, 2002 by the following
vote, to wit:
AYES: Commissioners Baker, Dominguez, Heineman, Trigas, White, and
Whitton
NOES: None
ABSENT: Commissioner Segall
