HomeMy WebLinkAbout2003-02-05; Planning Commission; Resolution 53641 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 5364 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL PLAN CONSISTENCY FOR THE CITY ACQUISITION OF VACANT PROPERTY LOCATED ON STRATFORD LANE. CASE NAME: STRATFORD LANE PROPERTY ACQUISITION CASE NO.: PCD/GPC 02-04 WHEREAS, the City of Carlsbad, “Developer,” has filed a verified application regarding property owned by Renate Pietsch, Heidi Pyle and Edward Zorn, “Owners,” described as See attached legal description (“the Property”); and WHEREAS, said verified application constitutes a request for a Planning Commission Determination for General Plan Consistency, on file in the Planning Department STRATFORD LANE PROPERTY ACQUISITION - PCD/GPC 02-04, as provided in Carlsbad Municipal Code Section 2.24.065 and Section 65402 of the California Government Code; and ‘ WHEREAS, the Planning Commission did on the 5th day of February, 2003 consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination of General Plan Consistency; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission hereby DETERMINES that the STRATFORD LANE PROPERTY 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ACQUISITION is consistent with the General Plan and APPROVES PCD/GPC 02-04, based on the following: Findinps: 1. This project is consistent with the goals, objectives, policies, and implementation programs of the City’s General Plan in that the property proposed to be acquired is contiguous to other parcels in city ownership. While these properties, including the subject property, is zoned for residential uses, public facilities are allowed subject to the conditional use permitting procedure. 2. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is categorically exempt from the requirement for the preparation of environmental documents pursuant to 15061@)(3) of the State CEQA Guidelines. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 5th day of February, 2003, by the following vote, to wit: AYES: Chairperson Baker, Commissioners Dominguez, Heineman, Segall, White, and Whitton NOES: None ABSENT: None ABSTAIN: None R, Chairperson COMMISSION ATTEST: MICHAEL J. HO~MILL~R Planning Director PC RES0 NO. 5364 -2- Legal Attachment to Resolution 5364 PARCEL 1: That portion of the Northwest Quarter of Section 6, Township 12 South, Range 4 West, San Bernardino Meridian, in the City of Carlsbad, County of San Diego, State of California, according to Official Plat thereof, described as follows: Commencing at a concrete monument at the Northeast comer of Tract No. 117 of Carlsbad Lands as shown on Map No. 1661, on file in the Office of the County Recorder of said County; thence along the Northerly line of said Tract No. 117 of Carlsbad Lands, North 89" 57' West 147.01 feet; thence North 0'55' West 20.00 feet; thence North 89'57' West 121.01 feet; thence North 0'55' West 155.00 feet to the True Point of Beginning; thence South 89'57' East 60.50 feet; thence North 0'55' West 133.50 feet more or less to a point on a 44.00 foot radius curve concave Northerly a radial line to said point bears S 011th 39'50'59" East, said curve being the Southerly right of way line of Stratford Lane as said street is described in deed to the City of Carlsbad recorded September 15, 1965 as File NO. 167284 of Official Records of said County; thence Westerly along said Southerly line of Stratford Lane and the arc or said curve 62.07 feet through a central angle of 80O49'18" to the beginning of a 25.00 foot radius reverse curve concave Southwesterly; thence continuing Westerly along said Southerly line of Stratford Lane and the arc of said curve 4.34 feet through a central angle of 9'57'14" to a point in the Westerly line of the land described in deed to Sloan M. Diu, et ux, recorded May 4,1951as Document No. 56580 of Official Records; thence along said Westerly line South 0'55' East 136.57 feet more or less to the True Point of Beginning.
