HomeMy WebLinkAbout2004-03-17; Planning Commission; Resolution 55991 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 5599 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL PLAN CONSISTENCY ON PROPERTY GENERALLY LOCATED AT 3368 EUREKA PLACE IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: GIRLS CLUB ACQUISITION CASE NO: PCD/GPC 04-02 WHEREAS, the City of Carlsbad, “Developer,” has filed a verified application regarding property owned by Carlsbad Girls Club, “Owner,” described as Lots 9 and 10 of Optimo Tract in City of Carlsbad (“the Property”); and WHEREAS, said verified application constitutes a request for a Planning Commission Determination of General Plan Consistency pursuant to Section 65402 of the California Government Code, on file in the Planning Department GIRLS CLUB ACQUISITION - PCD/GPC 04-02; and WHEREAS, the Planning Commission did on the 17th day of March 2004, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) B) That based on the evidence presented at the hearing, the Commission DETERMINES that GIRLS CLUB ACQUISITION - PCDlGPC 04-02 is consistent with the General Plan and APPROVES PCD/GPC 04-02 based on the following findings: That the foregoing recitations are true and correct. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Findinw: 1. This project is consistent with the goals, objectives, policies and implementation programs of the City’s General Plan in that the property proposed to be acquired is anticipated to be used for a public use (Le., the Learning Center). While the subject parcel is zoned for residential uses, public facilities are allowed in residentially zoned areas with approval of a Conditional Use Permit. 2. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt fiom the requirement for the preparation of environmental documents pursuant to Section 15301(a) and/or 15301(e) (Existing Facilities) of the state CEQA Guidelines. In making this determination, the Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project.
