A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION OF GENERAL
PLAN CONSISTENCY FOR THE CITY ACQUISITION OF
PROPERTY GENERALLY LOCATED AT 801 PINE AVENUE
IN LOCAL FACILITIES MANAGEMENT ZONE! 1.
CASE NAME: CUSD ADMINISTRATIVE OFFICES ACQUI-
SITION
CASE NO: PCD/GPC 03-03
WHEREAS, City of Carlsbad, “Developer,” has filed a verified application with
the City of Carlsbad regarding property owned by Carlsbad Unified School District, “Owner,”
described as
Portion of Blocks 46 and 59 of Town of Carlsbad Amended,
according to Map No. 775, filed in the Office of the County
Recorder of San Diego County on February 15, 1893, in the
City of Carlsbad, County of San Diego, State of California
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination for General Plan Consistency, on file in the Planning Department
CUSD ADMINISTRATIVE OFFICES ACQUISITION - PCD/GPC 03-03 as provided in
Section 2.24.065 of the Carlsbad Municipal Code and Section 65402 of the California
Government Code; and
WHEREAS, the Planning Commission did on the 5th day of May 2004, consider
said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:

That the foregoing recitations are true and correct.
That based on the evidence presented at the hearing, the Commission
DETERMINES that the CUSD ADMINISTRATIVE OFFICES ACQUISI-
TION is consistent with the General Plan and APPROVES PCD/GPC 03-03
based on the following findings:
project is consistent with the goals, objectives, policies and implementation
programs of the City’s General Plan in that the real property proposed to be acquired
is adjacent to the Carlsbad Senior Center and in close proximity to the Northwest
Quadrant Community Park site and may be used for park-related or recreational
programs or some other public purpose; and acquisition of the property will assist
in the provision for the social needs and public facility and service needs of the City.
That the Planning Director has determined that it can be seen with certainty that there is
no possibility that the project may have a significant effect on the environment, in that no
development or significant alteration in use is proposed; the site and the
surroundings are fully developed or are being redeveloped; no agricultural or
natural resources exist on site; and all facilities needed to accommodate the use are
already in place.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 5th day of May 2004, by the
following vote, to wit:
AYES: Chairperson White, Commissioners Baker, Dominguez, Heineman,
Montgomery, Segall, and Whitton
NOES: None
