PLANNING COMMISSION RESOLUTION NO. 5600
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT
BUDGET IS CONSISTENT WITH THE GENERAL PLAN ON
PROPERTY GENERALLY LOCATED CITYWIDE
CASE NAME: CAPITAL IMPROVEMENT PROGRAM
THE FY 2004-2005 CAPITAL IMPROVEMENT PROGRAM
BUDGET 2004-2005
CASE NO: PCD/GPC 04-01
WHEREAS, the City of Carlsbad, “Developer,” has filed a verified application
with the City of Carlsbad regarding property owned by various owners, “Owner,” described as
Citywide
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planning
Commission Determination of General Plan Consistency pursuant to Sections 65401 and
65402 of the California Government Code, on file in the Planning Department CAPITAL
IMPROVEMENT PROGRAM BUDGET 2004-2005 - PCD/GPC 04-01; and
WHEREAS, the Planning Commission did on the 5th day of May 2004, consider
said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Planning Commission Determination.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
That based on the evidence presented at the hearing, the Commission
DETERMINES that CAPITAL IMPROVEMENT PROGRAM BUDGET
2004 - 2005 - PCD/GPC 04-01 is consistent with the General Plan and
APPROVES PCD/GPC 04-01 based on the following findings:

The project is consistent with the goals, objectives, and policies of the City's General
Plan in that the project requires and ensures the provision of adequate public
facilities and services concurrent with or prior to need.
The project is consistent with the Land Use, Circulation, Public Safety, and Parks
and Recreation Elements of the General Plan in that the project implements the
Land Use Element goal requiring that public facilities be adequate to serve the
projected population of the City.
As required by the General Plan, the proposed improvements are consistent with
the City's Growth Management Plan in that the project ensures that the necessary
improvements are provided for parks, drainage, sewer, water distribution, traffic
signals, streets, and miscellaneous projects in accordance with the performance
standards contained in the City's Growth Management regulations.
That the projects listed as "exempt" or "not a project" in Exhibit "A" have been
found by the Planning Director to be exempt or are not a project within the meaning
of CEQA, and a Notice of Exemption will be filed by the Director upon final
approval of those projects as part of the FY 2004-2005 CIP Budget.
That the projects listed as "requiring CEQA review" in Exhibit "A" will not be
implemented until all required CEQA actions have been completed.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 5th day of May 2004, by the
following vote, to wit:
AYES: Chairperson White, Commissioners Baker, Dominguez, Heineman,
Montgomery, Segall, and Whitton
NOES: None
ABSENT: None
ABSTAIN: None
