PLANNING COMMISSION RESOLUTION NO. 5659
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
ADOPTION OF A NEGATIVE DECLARATION FOR A
GENERAL PLAN AMENDMENT, ZONE CODE
AMENDMENT AND LOCAL COASTAL PROGRAM
AMENDMENT TO ALLOW LARGE FORMAT RETAIL USES
WITHIN THE COMMERCIAL AND INDUSTRIAL LAND USE
DESIGNATIONS AND ZONES (EXCLUDING THE T-R LAND
USE DESIGNATION AND C-T ZONE), SUBJECT TO THE
APPROVAL OF A CONDITIONAL USE PERMIT.
CASE NAME: ENHANCED RETAIL OPPORTUNITIES
CASE NO.: GPA 04-07/ZCA 04-07/LCPA 04-06
WHEREAS, the Planning Director has prepared an amendment to the General
Plan and Title 21 of the Municipal Code (Zoning Ordinance) relating to large format retail uses;
and
WHEREAS, a Negative Declaration was prepared in conjunction with said
project; and
WHEREAS, the Planning Commission did on the 7th day of July 2004, hold a
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, examining the initial study, analyzing the information submitted by staff,
and considering any written comments received, the Planning Commission considered all factors
relating to the Negative Declaration.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Planning
Commission hereby RECOMMENDS ADOPTION of the Negative
Declaration (Exhibit “ND”) according to the NO1 dated May 26,2004, and EIA
Part I1 (Exhibit “PII”) dated May 11, 2004, attached hereto and made a part
hereof, based on the following findings:

Findinm:
1. The Planning Commission has reviewed, analyzed and considered the Negative
Declaration for ENHANCED RETAIL OPPORTUNITIES - GPA 04-07, ZCA 04-07
and LCPA 04-06, the environmental impacts therein identified for the project and any
comments thereon prior to RECOMMENDING APPROVAL, of the project; and
The Negative Declaration has been prepared in accordance with the requirements of the
California Environmental Quality Act, the State Guidelines and the Environmental
Protection Procedures of the City of Carlsbad; and
It reflects the independent judgment of the Planning Commission of the City of Carlsbad;
and
Based on the EIA Part I1 and comments thereon, there is no substantial evidence the
project will have a significant effect on the environment,

PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 7th day of July 2004, by the
