PLANNING COMMISSION RESOLUTION NO. 5661
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CODE AMENDMENT TO ADD A
DEFINITION FOR “LARGE FORMAT RETAIL,” AND ADD
“LARGE FORMAT RETAIL” AS A CONDITIONALLY
PERMITTED USE IN ALL COMMERCIAL AND INDUSTRIAL
ZONES, WITH THE EXCEPTION OF THE COMMERCIAL-
TOURIST (C-T) ZONE.
CASE NAME: ENHANCED RETAIL OPPORTUNITIES
CASE NO.: ZCA 04-07
WHEREAS, in accordance with Section 2 1.52.020 of the Carlsbad Municipal
Code, the Planning Director has prepared an amendment to Title 21 of the Municipal Code
(Zoning Ordinance) relating to large format retail uses; and
WHEREAS, the proposed amendment is set forth in the draft City Council
Ordinance, Exhibit “X,” dated July 7, 2004, attached hereto, ENHANCED RETAIL
OPPORTUNITIES - ZCA 04-07; and
WHEREAS, the Planning Commission did on the 7th day of July 2004, hold a
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, analyzing the information submitted by
staff, and considering any written comments received, the Planning Commission considered all
factors relating to the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Planning
Commission hereby RECOMMENDS APPROVAL of ENHANCED RETAIL
OPPORTUNITIES - ZCA 04-07, based on the following findings:

Findinm:
1. Th sed Zon Code Amendment, ZCA 04-07, is consistent with the General Plan in
that the amendments will ensure consistency with the objectives and policies of the
General Plan Land Use Element being amended by GPA 04-07. In addition, the
amendments to the Zoning Ordinance will assist in implementing the General Plan
goals to: 1) provide a “balance of both private and public land uses within
convenient and compatible locations throughout the community.. .,” and 2) provide
for land uses which “support and enhance the economic viability of the
community.”
2. The proposed Zone Code Amendment, ZCA 04-07, reflects sound principles of good
planning in that it: a) provides consistency with the General Plan; and b) provides
additional opportunities for retail uses within the city, which serves to implement
the City’s goals to provide a balance of land uses throughout the community, and
which enhance the city’s economic viability.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 7th day of July 2004, by the
following vote, to wit:
