HomeMy WebLinkAbout2005-02-16; Planning Commission; Resolution 58221 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 5822 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAFUSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LOCAL FACILITIES MANAGEMENT PLAN FOR A ZONE BOUNDARY ADJUSTMENT BETWEEN ZONE 5 AND 20 ON PROPERTY GENERALLY LOCATED SOUTH OF PALOMAR AIRPORT ROAD AND EAST OF HIDDEN VALLEY ROAD. CASE NAME: EMERALD RIDGE EAST LFMP AMENDMENT CASE NO.: LFMP 87-05(E)/LFMP 87-20(C) WHEREAS, City of Carlsbad has filed a verified application with the City of Carlsbad which has been referred to the Planning Commission; and WHEREAS, said application constitutes a request for a Local Facilities Management Plan Amendment for Zones 5 and 20 (dated April 24,2004, on file in the Planning Department) and incorporated by this reference (collectively referred to as the “Local Facilities Management Plan Amendments”), as provided in Section 21.90.125 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 16th day of February 2005, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Local Facilities Management Plan Amendment for Zones 5 and 20. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission RECOMMENDS APPROVAL of LFMP 87-05(E)/LFMP 87-20(C) - EMERALD RIDGE EAST, an amendment for Local Facilities Management Plans Zone 5 and 20, based on the following findings and subject to the following conditions: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Findinps: 1. That the Local Facilities Management Plan amendments for Zones 5 and 20 are consistent with Chapter 21.90 of the Carlsbad Municipal Code (Growth Management), and with the Citywide Facilities and Improvement Plan, in that they contain all matters required by Section 2 1.90.1 10 and thereby ensure implementation of and consistency with the General Plan and protect the public health, safety and welfare by ensuring that public facilities and improvements will be installed to serve new development prior to or concurrently with need. 2. That the Local Facilities Management Plan amendments for Zones 5 and 20 are consistent with Chapter 21.90 of the Carlsbad Municipal Code (Growth Management), and with the Citywide Facilities and Improvement Plan, in that the properties within the boundary adjustment are already developed or are open space and no impacts to public facilities will result. Conditions: 1. Approval is granted for the amendments to Local Facilities Management Plan - Zone 5 and 20 as contained in the Plan titled Local Facilities Management Plan Zone 87-05(E) and 87-20(C), dated February 16, 2005, on file in the Planning Department, and incorporated herein by reference. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad on the 16th day of February 2005, by the following vote, to wit: AYES: Vice Chairperson Montgomery, Commissioners Cardosa, Dominguez, Heineman, and Whitton NOES: ABSENT: Chairperson Segall and Commissioner Baker ABSTAIN: MARTELL B.
